THERE ARE, IN MY OPINION, WHAT IS PROPOSED IS NOT COMPARABLE TO THE SURROUNDING AREA.

AND IT'S GOING TO HAVE AN ADVERSE EFFECT ON THE HOME VALUES FOR EVERYONE THAT LIVES ALONG THE WEST SIDE OF SILVER SAND DRY.

THEY'RE PUTTING TWO HOMES BEHIND, BASICALLY BEHIND EACH AND EVERY HOT HOUSE ALONG SILVER SAND.

NOW, IF YOU CAN IMAGINE A 50 FOOT LOT, UH, RIGHT BEHIND YOUR HOUSE, UH, PROBABLY GOING TO BE TWO-STORY LOOKING RIGHT OVER YOUR FENCE INTO YOUR BACKYARD.

IF YOU DON'T THINK THAT'S GOING TO HAVE AN A FACT ON YOUR VALUE, I WOULD CALL YOUR ATTENTION TO LOOK AT WHAT'S GOING ON IN COPPER MILL SUBDIVISION, WHERE, UH, I BELIEVE IT'S DR.

I FIND IT VERY UNFORTUNATE THAT THE CURRENT ZONING AND THE UDC IS WRITTEN WOULD ALLOW PLACEMENT OF SUCH MASSIVE TALL BUILDINGS IN SUCH CLOSE PROXIMITY TO THE PROPERTY LINES OF BUDDING LOW DENSITY, SINGLE FAMILY, RESIDENTIAL, THE, UH, THE UDC ATTEMPTS TO MITIGATE THAT BY THE IMPOSITION OF BUFFER YARDS.

THE PURPOSE OF BUFFER YARDS.

AS I UNDERSTAND IT FROM READING THE UDC IS TO INTERRUPT SIGHT LINES BETWEEN A BUDDING USES THE PARTICULAR BUFFER YARD THAT WAS IMPOSED HERE.

THE L THREE BUFFER YARD, ACCORDING TO THE UDC, IT STATES THAT THAT STANDARD IS USED WHEN VISUAL SEPARATION IS REQUIRED.

THE L THREE BUFFER YARD PROPOSED ON THE SOUTH SIDE OF THIS DEVELOPMENT FULFILLS THAT PURPOSE AND MEETS THOSE REQUIREMENTS OR THE FIRST AND POSSIBLY PORTIONS OF THE SECOND FLOORS OF THIS FOUR STORY BUILDING.

AND I REALIZED THE UDC IS SILENT ON THIS ISSUE.

HOWEVER, THE BUFFER YARD PURPOSE AND REQUIREMENT IS UNMET ON THE UPPER FLOORS OF A FOUR STORY BUILDING.

IF, IF THIS WERE IN A HORIZONTAL CONFIGURATION, IF IT WERE 101 HUNDRED FOOT BUILDING THAT REQUIRED AN L THREE BUFFER, AND THE APPLICANT PROPOSED 25 TO 50 FEET OF BUFFER, I BELIEVE THAT SITUATION WOULD BE CONSIDERED NONCOMPLIANT WITH THE UDC.

THE SITUATION IS VERY SIMILAR IN MY MIND, AND I WOULD RESPECTFULLY REQUEST THE COMMISSION CONSIDER DENYING THIS SITE PLAN APPROVAL IN FAVOR OF PURSUING AN ALTERNATIVE THAT MAY PROVIDE A BUFFER TO THE SOUTH.

THAT IS A BIT MORE IN LINE WITH THE INTENT OF THE UDC FOR BUFFER YARDS AND ALSO TO PURSUE REFINEMENT OR REVISION OR CLARIFICATION TO THE UNIFIED DEVELOPMENT CODE, TO ADDRESS BUFFER YARD COMPLIANCE, WHERE THE BUDDING USE INVOLVES A MULTI-STORY BUILDING.
