THE IMPACT OF SLAVERY THROUGH MASS INCARCERATION CONTINUES TODAY.
THE UNITED STATES HAS THE HIGHEST RATE OF INCARCERATION OF ANY NATION ON EARTH.
WE REPRESENT 4% OF THE PLANET'S POPULATION, BUT 22% OF ITS IN PRISON IN THE EARLY 1970S, OUR PRISONS HELD FEWER THAN 3,300,000 PEOPLE, BUT DUE TO THE 94 CRIME BILL AND OTHER CRIME BILLS THAT CAME IN DURING THE EIGHTIES AND NINETIES, SINCE THEN, THAT NUMBER HAS GROWN TO MORE THAN 2.2 MILLION WITH 4.5 MILLION MORE ON PROBATION OR PAROLE.
BUT LOUISIANA HAS AN INCARCERATION RATE OF 1052 PER 100,000 PEOPLE, INCLUDING PRISONS, JAILS, IMMIGRATION DETENTIONS, AND JUVENILE JUSTICE FACILITIES ALTOGETHER, MEANING THAT IT LOCKS UP A HIGHER PERCENTAGE OF HIS PEOPLE THAN MANY WEALTHY DEMOCRATIC DEMOCRACY STEW.
OUR SOURCE CAME FROM THE PRISON POLICY INITIATIVE AND BLACK PEOPLE ARE OVERREPRESENTED IN LOUISIANA'S PRISONS AND JAILS.
ACCORDING TO DATA IN 2010, THE TOTAL POPULATION OF BLACK PEOPLE IN LOUISIANA WAS ROUGHLY ABOUT 32%, BUT WE MADE UP ROUGHLY 66% OF THE INCARCERATED POPULATION.
AGAIN, THIS SOURCE CAME FROM THE PRISON POLICY INITIATIVE AND ALSO THE 2010 CENSUS DATA.
AND ALSO WOULD LIKE TO LOOK AT THIS EXPERIENCE OF SOMEONE WHO IS AN ATTORNEY.
HE HAD HIS STORY PUBLISHED IN THE NEW YORK TIMES.

IT SEEMED KEENLY AWARE THAT WE WERE NATURALLY FREE FROM THE BURDEN OF LIVING IN A NATION THAT CONTINUES TO DENY IN DOUBT THIS LEGACY AND HOW MUCH WORK REMAINS TO BE DONE.
AND I WANTED TO TAKE A COUPLE OF SECONDS TO JUST REFLECT ON MEN WHO SURVIVED THE FIELDS IN THE HOLE IN ANGOLA.
WE STILL HAVE PEOPLE IN PRISON THAT ARE PICKING COTTON, DOING AGRICULTURAL WORK, WHERE WE HAVE MULTI-BILLION DOLLAR CORPORATIONS BENEFIT OFF OF THEIR LABOR, WHERE THEY MAKE A LITTLE TO NOTHING.
AND IF THEY DO STRIKE BECAUSE THEY DON'T FEEL THE BENEFIT OF GOING TO WORK BECAUSE THEY'RE NOT GETTING PAID ANYTHING, THEY ARE SUBJECTED TO THE HOLE, WHICH IS A MINI CASE OF SOLITARY CONFINEMENT.
AND WE'VE HAVE PLENTY OF DATA OUT THERE THAT SHOWS HOW THAT IMPACTS NEGATIVELY IMPACTED OUR, UH, PSYCHE.
AND JUST TO ALSO TOUCH ON A FEDERAL CASE WHERE PLAINTIFF BENJAMIN F SHIPLEY VERSUS WARWICK INCORPORATED, THIS WAS A FEDERAL CASE WHERE IN TERRE HAUTE, INDIANA PRISONER IN THE FEDERAL PRISON SYSTEM FILED A COMPLAINT SEEKING MINIMUM WAGES UNDER THE FEDERAL LABOR STANDARDS ACT F L S A SIDING, THE LONG STANDING CASE LAW FROM AROUND THE COUNTRY, THE COURT DISMISSED SHIPLEY'S COMPLAINT, BOEING FILING HIS COMPLAINT UNDER THAT FEDERAL ACT BECAUSE IT FAILED TO STATE A CAUSE OF ACTION DISCUSSING SHIPLEY'S LACK OF 13TH AMENDMENT RIGHTS OR THAT UNDER THAT, UH, HE WAS NOT PROTECTED UNDER THE LSA.
THE JUDGMENT WENT ON TO SAY IT AS WELL, SETTLED THAT THE 13TH AMENDMENT PROTECTION AGAINST INVOLUNTARY SERVITUDE DOES NOT EXTEND TO PRISONERS WHO ARE REQUIRED TO PERFORM WORK AT LITTLE OR NO PAY TO THE CONTRARY.
THE 13TH AND MIMIC CLEARLY ACCEPTS VOLUNTARY INVOLUNTARY SERVITUDE AS PUNISHMENT FOR A CRIME AT THE CONVENTION, NEITHER SLAVERY NOR INVOLUNTARY SERVITUDE, EXCEPT AS A PUNISHMENT FOR A CRIME WHERE THE PARTY SHALL HAVE BEEN DULY CONVICTED SHALL EXIST WITHIN THE UNITED STATES OR ANY PLACE SUBJECT TO THEIR JURISDICTION.
BUT SHE ALSO MEANS LOUISIANA WITH ARTICLE ONE, SECTION THREE ANNOUNCED CONSTITUTION.
AND THERE ARE SIMILAR CASES THAT HAVE CAME UP IN THORNBURG DEPARTMENT OF THE NAVY IN 1994 AND ALSO SANDERS VS HAYDEN IN 2008.

I SAID, WHY? HE SAID, BECAUSE THEY WERE WORKING SO HARD AND I, WHATEVER THE TULARE YOU, HE SAID, HE TOLD EVERYBODY, PUT YOUR WET, PUT YOUR TOOLS DOWN.

AND WHEN WE LOOK AT THAT AND THE RESPONSE AND REACTION TO THOSE LAWS AND POLICIES THAT HAS NOT, UH, DECREASED OUR, UH, CRIME RATE, UH, GIVING PEOPLE MORE TIME, UH, INCREASING THE PUNISHMENT HAVE NOT DETERRED PEOPLE FROM CRIME.
I'VE ALWAYS SAID THAT JOBS AND INCOME OPPORTUNITY IS WHAT DOES THAT.
SO I THINK IF WE FOCUS MORE ON THAT AND LESS ON BEING HARD ON CRIME, BUT BEING SMART ON CRIME, THEN WE WOULD, UH, REDUCE OUR PRISON POPULATION.
WE ALL KNOW LOUISIANA IS THE, UM, UH, INCARCERATION CAPITAL OF THE WORLD.
