WE'VE BEEN IN CONSTANT COMMUNICATION WITH OUR COUNCILMAN ROWDY, AS WELL AS THE DEVELOPER AND ENGINEER FOR THIS LAND, ART LANCASTER AND MICKEY ROBERTSON.

ALTHOUGH THEY HAVE PRESENTED MANY OPTIONS ATTEMPTING TO ADDRESS OUR CONCERNS.

IN REALITY, WE HAVE TO, TO REZONE OR NOT REZONE, LET'S SAY YOU APPROVE A REZONE.

THERE ARE NO GUARANTEES THAT ANY CURRENT PLANS WILL BE UPHELD.

YES, A PUD ZONE DEVELOPMENT IS ATTACHED TO A SPECIFIC PLAN, BUT WE ALL KNOW THAT THESE PLANS ARE EASY TO CHANGE AND DO NOT STIPULATE QUALITY OF WORK.

LET'S LOOK AT TWO INSTANCES OF THIS, THE COTTAGES AFTER REZONING ART LANCASTER SOLD THIS LAND IN FRONT OF OUR NEIGHBORHOOD TO DSLD TODAY.

THIS DEVELOPMENT DOES NOT REFLECT THE PROPOSED AND APPROVED PLAN.

THESE HOMES ARE ALREADY FALLING APART WITH 30 MILE AN HOUR WINDS AND POOR QUALITY CRAFTSMANSHIP.

THEY COULD END UP LIKE THE APARTMENTS ACROSS THE STREET ON BURBANK BEING PROPPED UP BY TWO BY FOURS, ANOTHER PLAN DEVELOPMENT GOING WRONG TO PELICAN LAKES.

THIS IS ANOTHER ART LANCASTER DEVELOPMENT.

CURRENTLY GOING BACK TO THE PLANNING COMMITTEE, AFTER A REASON TO CHANGE THE APPROVED PLAN, TO ADD MORE HOUSES AND DECREASE THE GREEN SPACE.

EVERY PLAN HE HAS GIVEN MEANS NOTHING.

IF HE HAS INTENTIONS, JUST TO GO BACK TO THE PLANNING COMMITTEE TO RECONFIGURE IT, LANCASTER NEEDS THE REASON TO MAKE ENOUGH MONEY FOR THIS LAND INVESTMENT TO BE WORTHWHILE.

HE DOESN'T NEED A REASON TO DEVELOP THE LAND.

THIS IS FUNDAMENTALLY WHY WE ARE AGAINST THE REASON WE ARE BEING MADE PROMISES THAT WON'T BE KEPT AS ART AS DEMONSTRATED TIME AND TIME AGAIN, LET'S ALSO DISCUSS THE ELEPHANT IN THE ROOM, FLOOD RISK.

ALTHOUGH FLOOD RISKS REMAINS WITH DEVELOPMENT OF THIS LAND WITH OR WITHOUT A REZONE.

WE BELIEVE THAT WITHOUT THE REASON THIS LAND WILL NOT BE DEVELOPED AS A PROFIT MARGIN WILL BE TOO SMALL.

SO REZONING IS ARTS PATHS TO DEVELOPMENT AND THUS INCREASED FLOODING.

EVEN THOUGH HIS ENGINEER ENSURES DEVELOPMENT TO ACCOMMODATE AN A 100 YEAR FLOOD THE WATER FROM THIS AND OTHER DEVELOPMENTS MUST GO SOMEWHERE.

INSTEAD OF PREPARING FOR WHAT WE HAVE ALREADY EXPERIENCED, WE NEED TO LOOK AHEAD AND PLAN FOR WHAT WILL HAPPEN IN THE FUTURE WITH THE COMBINED EFFECTS OF MORE DEVELOPMENT, IMPAIRED DRAINAGE SOLUTIONS AND CLIMATE CHANGE.

THESE THINGS DON'T HAPPEN IN A SILO IN THE REAL WORLD, BUT THEY OFTEN DO HERE WHEN DISCUSSING INDIVIDUAL PROJECTS, LEADING DISASTER RESPONSE.

AS THE CITY'S ONLY OPTION DEVELOPERS CAN TELL US THEY'VE WORKED THE NUMBERS, BUT THERE IS NO SYSTEM IN PLACE TO HOLD THEM ACCOUNTABLE.

AS JR BALL NOTED IN HIS RECENT PIECE IN BUSINESS REPORT, THEY NEED TO BE RESPONSIBLE FOR PROPERTY ISSUES LONG AFTER THEY ARE DEVELOPED, INCLUDING FLOODING FOUNDATION ISSUES AND MORE IN ANY OTHER PROFESSION AND AFFECTING THE COMMUNITY.

YOUR WORK IS HELD ACCOUNTABLE BY GOVERNING BODIES AND LICENSURE.

PUTTING YOUR LICENSE ON THE LINE AS COLLATERAL FOR THE PROMISE OF GOOD WORK.

WE, YOUR CONSTITUENTS HAVEN'T REALLY HAD A SAY IN WHAT IS HAPPENING AROUND US FROM OUR UNDERSTANDING.

THIS IS THE FIRST TIME DEVELOPERS IN THE AREA HAVE RECEIVED PUSHBACK.

I TRULY BELIEVE THAT THIS IS AN OPPORTUNITY FOR YOU, THE COUNCIL MEMBERS TO DO THE RIGHT THING AND REPRESENTED OUR WISHES TO VOTE.

SO EVEN THE COUNCIL GOT ME, I'M RACING HERE TRYING TO GET HERE ON TIME.

TRAFFIC WAS PRETTY CRAZY LOW WINDED.

UM, NAME'S BEN O'CONNOR, I'M THE PRESIDENT OF THE HOMEOWNER'S ASSOCIATION FOR A UNIVERSITY OF VILLAS.

UM, IF ANY OF YOU ARE NOT FAMILIAR WITH THE UNIVERSITY OF VILLA, IT'S A 245 LOT A GATED SUBDIVISION ADJACENT TO THE PROPOSED, UH, MAPLE COVE DEVELOPMENT.

UM, WE HAVE MET WITH OUR COUNSELOR, UH, MR. RODDY, UM, UH, ART AND MICKEY, THE DEVELOPER AND ENGINEERS FOR THIS NUMEROUS TIMES, GOING BACK AND FORTH BETWEEN SOME OF THE PROPOSED PLANS.

UM, BUT UNFORTUNATELY THE FLOOD RISKS ARE STILL STAYING ABOUT THE SAME, UM, WHETHER YOU'RE CHANGING, YOU KNOW, HOW MANY LOTS ARE ON THIS LAND, UM, TO THE, THE AMOUNT BETWEEN EIGHTH OR D OF THE PROPOSALS.

UM, THE RISK STILL STAYS THE SAME BECAUSE BY YOU FOUND, UH, FOR THE TIME BEING, DOESN'T SEEM TO BE CHANGING ANYTIME SOON, UH, EXCEPT FOR THE FACT THAT MORE AND MORE WATER IS BEING PUSHED NOW INTO IT BECAUSE OF THE CONTINUED DEVELOPMENT ALONG BURBANK.

UM, THAT'S SOMETHING THAT WE DISCUSSED WITH THEM.

UM, AND OUR BIGGEST CONCERN WAS THIS DEVELOPMENT DOES HAVE A DETENTION POND IN IT AS IT'S REQUIRED TO.

UM, BUT UNFORTUNATELY THAT DETENTION POND FLOWS INTO OUR LAKE, UH, WHICH THEN FLOWS INTO BY FOUNTAIN.

AND OUR BIGGEST CONCERN IS AS BY FOUND CONTINUES TO RISE, UM, WITH MORE AND MORE OF THESE FLOODING EVENTS, OUR LAKE ALSO DOES TO THE SAME LEVEL AS WELL.

UM, SO THE PROBLEM WITH THIS WETLAND AND IT'S A WETLAND, THIS PROPOSED AREA, IT'S A REGISTERED WETLAND, IS THAT IT ABSORBS ALL THE WATER ON ITS PROPERTY, BUT ALSO ALL THE PROPERTIES ACROSS BY A FOUNTAIN, UM, BY EVERYTHING I'M SORRY, BURBANK, EVERYTHING ACROSS FROM US ON THE OTHER SIDE OF BURBANK FLOW IS UNDERNEATH, UM, THERE A HUGE, UM, DRAINAGE SYSTEM.

AND THEN IT GOES INTO THIS WETLANDS AREA.

UM, AND THE PROBLEM IS BY DEVELOPING THIS NOW YOU'RE ELIMINATING THAT SPONGE THAT IS NATURALLY THERE TO ABSORB THAT WATER, UM, WHICH THAT'S THE ONLY PUSHES IT QUICKER AND FASTER AND MORE OF IT NOW AND OR DETENTION POND.

UM, AND IT'S OUR HOMES.

UH, WITH OUR MOST RECENT FLOODING EVENT, WE ACTUALLY HAD WATER TOUCHING THE FOUNDATIONS OF OUR HOMES ALONG OUR DETENTION PONDS.

AS YOU CAN IMAGINE, THAT'S A HUGE CONCERN WITH MORE AND MORE DEVELOPMENTS.

NOW WHERE'S THIS WATER GOING TO GO IF IT'S ALREADY TOUCHING OUR FOUNDATIONS, UM, AT THAT POINT, IT'S GOING TO NOW JUST BE GOING INTO OUR HOMES.

UH, OUR HOME VALUES HAVE GONE UP SOME OF THESE HOUSES ANYWHERE FROM 60,000 TO A HUNDRED THOUSAND IN THE PAST SEVEN YEARS.

IT'S FABULOUS.

WE LOVE IT.

I'M SURE THE CITY LOVES IT TOO.

IT'S GREAT TAX REVENUE, BUT THE PROBLEM WITH THAT IS IF THESE HOMES FLOOD, ALL OF THESE HOMER, UH, VALUES ARE GOING TO TANK AND AS WELL AS ALL THE BUSINESSES THAT SUPPORT THAT.

SO WE JUST KINDLY ASK THAT YOU RECONSIDER THIS AND NEED TO MAKE SURE THAT, UH, YOU GO ALONG WITH THE PLANNING COMMISSION AND, YOU KNOW, PROJECT THIS PROPOSAL.

CURRENTLY RURAL, UH, THE PROPOSAL WAS TO GO TO PUD PLAN, USE DEVELOPMENT.

I HAVE CONCERNS ABOUT THE USE BY RIGHT OR THE PROPERTY.

SO IF IT REMAINS RURAL, THERE IS A DEVELOPMENT THAT COULD TAKE PLACE THAT I BELIEVE THE NEIGHBORS WHO WOULD HAVE THIS PROPOSED DEVELOPMENT IN THEIR BACKYARD WOULD BE, UH, AGAINST.

AND SO I WANTED TO FACILITATE CONTINUED CONVERSATIONS, UH, WITH BOTH PARTIES.

I THINK THE MOTION TODAY TO DELETE, UH, REMOVES THIS FROM THE AGENDA.

AND SO THE NEIGHBORS KNOW THAT THE, THE CHANGE OF ZONING WILL BE REMOVED.

UH, THAT BEING SAID, THE NEIGHBORS NEED TO UNDERSTAND THAT THE DEVELOPER, UH, CAN GO BACK TO THE DRAWING TABLE AND COME IN AT A FUTURE DATE WITH A NEW APPLICATION.

EVERY RAIN EVENT, THREE FOOT OF WATER, EVERY RAIN, NOT JUST IN FRONT OF MILES, THAT'S, THAT'S FROM, UH, SIX TO EIGHT 30, WHICH IS OAK CAPITOL.
