I'M THE ORIGINAL DEVELOPER OF ROUSSANNE AND, UH, HAVE, UH, A SMALL PIECE OF PROPERTY IN THE BACK OF RUSE ON 1.65 ACRES THAT WE'VE GOT AN APPLICATION BEFORE YOU TODAY TO, UH, TO REZONE FROM 1, 1, 1, LOT TO, UH, UH, WE WANT TO ADD SIX ADDITIONAL LOTS, UH, RUSE ON, UH, THIS PAST AUGUST Y'ALL APPROVED A 55 LOT INCREASE, UH, FOR THE, UH, FOR MR. ANGUISHED, UH, THAT WENT FROM 750 TO 805.

AND, UM, SO WE'D LIKE TO, WE, WE, WE CAME ON THE TAILS RIGHT BEHIND THAT TO TRY TO GET ALL OF THIS BEFORE YOU GET THE SAME TIME.

BUT MINE ENDED UP GETTING DEFERRED, I THINK THREE TIMES.

UH, SO WE'RE HERE, WE'RE HERE TODAY.

AND SO WE ASKED FOR YOUR APPROVAL OF THIS SIX LOTS AGAIN, YOU JUST RECENTLY APPROVED 55.

SO WHY WOULD SIX MORE BE A PROBLEM IT'S LESS THAN A 1% INCREASE.

I WAS HERE TODAY IN OPPOSITION TO THIS, MAINLY BECAUSE AS MR. TOMMY SAID, Y'ALL DID A LOT WITH AN INCREASE OF 55 LOTS BACK IN AUGUST, BUT THAT WAS DONE AFTER MONTHS OF NEGOTIATIONS WITH THOSE DEVELOPERS, THEY CAME TO THE CIVIC ASSOCIATIONS IN THE NEIGHBORHOOD, SAT DOWN WITH US.

WE WENT THROUGH DRAWINGS, WE HAD MULTIPLE EMAILS.

WE HAD SESSIONS WHERE WE WOULD GO MEET WITH THEM IN THE EVENINGS AND GO THROUGH WHAT WAS GOING TO BE DEVELOPED, HOW IT WAS GOING TO BE DEVELOPED, WHAT WOULD BE BUILT, WHERE WOULD BE BUILT.

AND IF IT WASN'T BUILT THAT WAY, THEY COULDN'T BUILD ANYTHING ELSE THERE.

AND SO WE GOT TO MEET WITH THE DEVELOPERS AND PUMPED ON NEGOTIATION THAT THE NEIGHBORHOODS COULD LIVE WITH.

AND THEY WERE PUTTING MORE RESIDENTIAL, WHICH WAS, I BELIEVE ORIGINALLY SCHEDULED TO BE COMMERCIAL, COMMERCIAL LAND.

SO WE MET WITH, UH, TOMMY CAME TO OUR CIVIC ASSOCIATION ONCE IN SEPTEMBER, TALK TO US.

I MET WITH HIM AGAIN AFTER THAT.

AND FROM THERE, WE'VE HAD NO CONVERSATIONS WITH THEM.

UM, WE HAVE NO AGREEMENT AS TO WHAT'S GOING TO BE BUILT, HOW IT WILL BE BUILT, UM, THERE'S ISSUES WITH POTENTIALLY FLOODING IN THE AREA.

IT WAS ALWAYS THAT LOT WAS ALWAYS DESIGNED TO HAVE JUST ONE HOUSE ON IT.

NOW HE'S ASKING TO PUT SEVEN HOUSES, THREE OF WHICH MAY BE MIXED RESIDENTIAL.

AND THERE'S JUST A BUNCH OF ISSUES THAT WE DON'T HAVE ANSWERS TO.

AND HE'S ASKING FOR THE METRO COUNCIL ORDINANCE TO BE CHANGED.

THE IMPORTANCE OF THAT IS THAT ORDINANCE WAS PUT IN PLACE WHEN ROSEANNE WAS FIRST PASSED TO GIVE SOME PROTECTIONS TO THE NEIGHBORHOODS THAT WHAT WAS AGREED UPON COULD NOT BE CHANGED WITHOUT COMING BACK TO Y'ALL AND NOT JUST THE PLANNING COMMISSION.

IT GIVES THE NEIGHBORHOODS A CHANCE TO SAY, NO, NO, WE DON'T BELIEVE THIS SHOULD WORK THIS WAY.

ONE OF THE ISSUES WE HAD WAS, UM, THE, UH, DESIGN MR. SPINOSA SHOWED US WAS FOR NEIGHBORHOOD EDGE LOTS.

THEY'RE SUPPOSED TO BE 55 BY ONE 10.

I WOULD BELIEVE IN THE BUILDING INDUSTRY, YOU WOULD TAKE THAT TO BE 55 WIDE BY ONE, 10 DEEP.

HE WANTS TO FLIP TWO OF THOSE LOCKS, SO THAT THEY'RE ONE 10 WATT AND 55 DEEP.

THAT'S GOING TO PUT THAT HOUSE IN THE PEOPLE THAT LIVE ON BRAHM AND IN THE METAL,

THE NEIGHBORHOOD THAT'S GOING TO PUT THEM RIGHT INTO THEIR BACKYARD.

IT VIOLATES THE SPIRIT OF WHAT WAS DONE WHEN WE PASSED THE ORDINANCE TO HAVE NEIGHBORHOOD OUTAGE, EVERY OTHER NEIGHBORHOOD EDGE LIGHT, AND ROSEANNE IT'S 55 WIDE, ONE 10 DEEP THOUGH, I'D ASK THAT YOU DENY THE MOTION THAT'S PENDING IN FRONT OF Y'ALL TONIGHT.

THEY D THEY INVOLVE CONNECTIVITY WITH HYACINTH AND, UM, WITH EVEN ROSEANNE, MOST IMPORTANTLY, THEY INVOLVE THE, UM, A COMPLETE DISREGARD OF THE T AND D PRINCIPLES OF NEIGHBORHOOD EDGE ALLOTS.

AND IT'S THE MOST GLARING EXAMPLE OF THAT BECAUSE HIS DEVELOPMENT OR HIS LOT IS IN PEOPLE'S BACKYARDS.

THE, THE, IF, IF YOU KNOW THE MAP, IT IS DIRECTLY IN THE BACKYARDS OF THE PEOPLE ON METALLY IN THEIR BACKYARD.

YOU'VE HEARD ME TRY TO TALK ABOUT IT BEFORE, BUT AFTER A, A CONTENTIOUS FIGHT, UH, THE METRO COUNCIL AT THAT TIME, PASTORS, AND THEY GAVE MR. SPINOSA WHAT HE WANTED SEVEN 50 LOTS, UM, A HUNDRED THOUSAND COMMERCIAL, BUT THEY WROTE IT INTO THE ORDINANCE.

AND SO IT BECAME PART OF THE LAW.

AND THAT MEANT THAT THIS COULD NOT BOUNCE BACK AND FORTH TO THE PC.

IT WOULD HAVE TO COME TO THE METRO COUNCIL TO BE CHANGED.

THAT WAS UTTERLY UNIQUE.

THE ORDINANCE WAS, UM, HAS BEEN A COVETED FEATURE.

THAT'S BEEN OUR ONLY PROTECTION.

IT'S NEVER, IT NEVER GETS CHANGED.

Y'ALL Y'ALL HAVE BEEN HERE FOR AWHILE.

I'VE BEEN COMING BACK AND FORTH HERE FOR A LONG TIME.

THIS ORDINANCE HAS NEVER BEEN CHANGED.

IT WAS KNOCKED OUT BY THE ALEC SANTA, MY LAWSUIT IN 2014 CHANDLER LOOP.

AND, AND EVERYBODY THERE PUT OUR STIPULATIONS BACK IN THE ORDINANCE, EVERYBODY WITH ME.

SO WE'RE HERE BECAUSE OF THE ORDINANCE.

WE HAVE TO GIVE LOTS BECAUSE IT'S, THE TICKETS ARE SOLD OUT.

THERE IS NO MORE LOTS LEFT.

AND WHEN WE'VE APPEARED, IT'S BEEN TO AGREE WITH THEM WITH A COMPROMISE AGREEMENT.

AND THAT'S EXACTLY WHAT WE DID WITH THE, UM, WITH CHARLES.

HE WANTED 55 LOTS.

WE LOOKED AT IT AND WE'RE THINKING WE COULD DO THIS.

WHERE ARE THEY GOING? THEY'RE ALL IN THE FRONT OF ROUSSANNE, THEY'RE IN THE FRONT.

AND THEY'RE ALL ON COMMERCIAL TRACKS.

SO HE'S PUTTING A RESIDENTIAL AND COMMERCIAL TRACKS IN THE FRONT OF ROSEANNE.

THEY'RE WORKING ON THOSE.

AND SO WE APPRECIATE THEIR EFFORTS.

UM, THE LAND THAT MR SPINOSA WANTS TO TURN FROM ONE HOME SITE INTO SEVEN IS PASTURE LAND THAT DIRECTLY DRAINS INTO OUR BACKYARDS ON WHITE HAVEN.

IT CROSSES THE STREET, IT GOES IN THE STORM DRAIN.

IT HITS OUR SMALL POND AND THEN TRAVELS ON ITS WAY TO FLOODING A NUMBER OF YARDS.

UH, IT WAS INCHES FROM MY HOUSE.

IT DID FEEL THE FIRST FLOOR OF MY HOUSE AND A NUMBER OF OTHER NEIGHBORS, NOT IN THE HOUSE, BUT ALMOST, AND WE JUST FEEL LIKE, UNLESS THERE'S A PROPER DRAINAGE PLAN FOR THESE ADDITIONAL CELL SEVEN HOMES, YOU'RE PUTTING CONCRETE OVER PASTURE LAND THAT USED TO ABSORB THE WATER.

MORE WATER WILL BE COMING.

UM, MR. SPINOSA AND I'VE MET MANY TIMES THIS PAST YEAR, UM, HE TOLD ME HE WAS TYING INTO THE ROUSSANNE DRAINAGE SYSTEM.

UM, IT'S 1.6 ACRES.

THE WATER ALREADY COMES THROUGH ON THE HOME AT WHITE HAVEN.

NOW, UM, IT COMES ACROSS THE STREET.

WE SEE IT EVERY TIME IT RAINS.

WE HAVE OLDER PEOPLE IN THE NEIGHBORHOOD ARE EXPERIENCING FLOODING, NOT QUITE IN THEIR HOUSE, BUT ALMOST IN THEIR HOUSE.

AND, UH, OVER THE YEARS, BEING INVOLVED WITH ROSEANNE FOR 14, 15 YEARS, THE NUMBER ONE COMPLAINT WAS THAT HOUSES WOULD STACK UP BEHIND A ONE, LOTS, A HUNDRED FOOT, 81 LOTS YOU'D GET TWO AND THREE HOUSES.

AND ROSEANNE DID BACKING UP TO THEM.

THAT'S THE NUMBER ONE COMPLAINT I'VE GOTTEN OVER THE YEARS.

IT'S ALSO THE NUMBER ONE COMPLAINT I HEARD FROM THESE PEOPLE.

SO WE CAME UP WITH AN IDEA.

THAT'S WHY, IF YOU LOOK AT PAGE THREE, WE WOULD TURN THE LOTS.

AND WHEN THEY'RE SIDE AND HE WAS INCORRECT STATING, AND BY THE WAY, THEY HAVE COPIES OF THIS MAP.

THEY WAS SAID THE LOSS WERE ONLY 55 FOOT DEEP.

THEY'RE NOT, THERE'S 70 FOOT DEEP.

HE WAS COMFORTABLE THAT THAT WOULD WORK ALSO.

SO THE LOT SIZE IS, DO WORK, AND THIS WAS DONE FOR THE BENEFIT OF THE PEOPLE.

SO I'M NOT DOING WHAT I CALL A RACK AND STACK DESIGN LIKE ROSEANNE HAS, THEY HAVE 77, 55 BY ONE, 10 OR ONE 20 LOTS GOING IN A ROW.

WE HAVE SPOKEN TO THEM AND THEY ARE SATISFIED THAT THEY ARE NOT HAVING FLOODING ISSUES ANYMORE AT THE ENTRANCE TO PELICAN LAKES.

SO IF SOMEBODY WAS TO COME BACK AND RUN THIS SPECIFIC EVENT THAT COULD HAPPEN, THE ONLY PROBLEM IS THEY'D BE OUT OF BUSINESS.

AND I MEAN, IT WAS CANCELED BECAUSE IT WAS BAD FOR BUSINESS.
