THERE'S AN OBJECTIVE IN THE, UH, COMMUNITY DESIGN ELEMENT THAT, UH, TALKS ABOUT ENHANCING EXISTING NEIGHBORHOODS BY ELIMINATING BLIGHT AND PROPERTIES.

THERE'S ALSO AN OBJECTIVE IN THE ENVIRONMENT AND CONSERVATION ELEMENT THAT DEALS SPECIFICALLY WITH REMEDIATING BROWNFIELD SITES.

AND IN THAT SAME VEIN, I AM HAPPY TO ANNOUNCE THAT THE EPA HAS SELECTED EAST BATON ROUGE PARISH FOR A $500,000 BROWNFIELD ASSESSMENT GRANT.

THIS IS THE MOST EAST BATON ROUGE HAS EVER BEEN AWARDED FOR THIS GRANT.

UM, THE TIGER, THE TARGET AREAS FOR THE GRANT ARE TO BE MID CITY, THE PLANK ROAD CORRIDOR, AND THE SCOTLANDVILLE NEIGHBORHOOD.

ALL THREE ARE, UH, COMMUNITIES WITH ENVIRONMENTAL JUSTICE CONCERNS.

SO THAT IS WHAT WE WILL BE SPECIFICALLY WORKING ON, UM, WITHIN OUR BROWNFIELD PROGRAM.

AGAIN, THIS IS ANOTHER TEXT AMENDMENT THAT WAS INITIATED BY THE PLANNING COMMISSION SEVERAL MONTHS AGO.

AGAIN, STAFF HAS WORKED CLOSELY WITH THE DEPARTMENT OF DEVELOPMENT AND THE PARIS ATTORNEY'S OFFICE.

WE HAVE IDENTIFIED THREE SMALL REVISIONS TO EXISTING DEFINITIONS WITHIN THE UNIFIED DEVELOPMENT CODE.

UH, SPECIFICALLY CHAPTER 19 STAFF RECOMMENDS APPROVAL BASED ON CONSISTENCY WITH THE COMPREHENSIVE PLAN AND THE NEED TO CREATE A MORE USER-FRIENDLY UDC.

THIS AMENDMENT WOULD MODIFY THE FOLLOWING DEFINITIONS, OFFICE WAREHOUSE, FLEX SPACE, AND ALSO THE DEFINITION OF MONUMENTS ON AND THE DEFINITION OF PROJECTING SIGN.

AGAIN, THERE'S, THERE'S MINOR MODIFICATIONS TO THESE EXISTING DEFINITIONS.

UH, THE TWO SIGNED DEFINITIONS

IT'S LOCATED BEHIND THE ACADEMY IN FRONT OF HIDDEN OAKS APARTMENTS, RIGHT THERE OFF OF INDUSTRIAL EGGS AT SEGUN WE'RE PROPOSING 78 UNITS ON A PIECE OF PROPERTY THAT IS CURRENTLY ZONED A C2.

AND WE ARE ASKING FOR A DOWN ZONING TO 82.5 SO THAT WE CAN HAVE A USE.

THAT'S MORE COMPATIBLE WITH THE EXISTING SINGLE FAMILY RESIDENTIAL DEVELOPMENTS THAT ARE AROUND IT.

THE, YOU KNOW, OBVIOUSLY THE CURRENT C2 ZONING COULD ALLOW FOR A LOT MORE PERMISSIBLE USES.

UH, THERE A LOT MORE ONEROUS THAN A TOWNHOME DEVELOPMENT.

OUR DEVELOPMENT IS GOING TO BE PRIVATE, GOING TO BE GATED PRIVATE STREETS.

UH, WE'RE GOING TO PROVIDE ABOUT 25% GREEN SPACE.

WE HAVE, YOU KNOW, AS PART OF OUR RESEARCH, WE OBTAIN THE AS-BUILT DRAINAGE, UH, PLANS FOR JEFFERSON TERRA, SIX FILING, WHICH ABUTS US TO THE NORTH SIDE.

WE HAVE THE APARTMENT COMPLEX ON OUR WEST SIDE, UH, SO THAT WE MADE SURE WE PROPERLY ADDRESSED ANY DRAINAGE CONCERNS THAT WERE THERE.

THE, THERE IS A LARGE AMOUNT OF DRAINAGE COMING FROM THE NORTH THAT GOES THROUGH OUR SITE THROUGH A CURRENT DITCH THAT IS PARTIALLY LOCATED IN THE PUBLIC DURING THE SERVITUDE AND PARTIALLY OUTSIDE OF A PUBLIC DRAINAGE SERVITUDE.

SO WE ARE GOING TO REALIGN THAT DITCH AND REDEDICATE THE PUBLIC DRAINAGE SERVITUDE FOR THE ENTIRE DITCH.

WE'RE GOING TO CLEAN IT OUT, WIDEN IT I'LL MAKE THE DRAINAGE BETTER FOR THE AREA.

WE HAD A MEETING LAST WEEK WITH THE BOARD FORM, JEFFERSON TERRACE, SIX FILING.

THEY HAD QUESTIONS ABOUT DRAINAGE, ABOUT SETBACKS UPBRINGING, SPACE FUCKED UP THE QUALITY OF THE HOMES THAT WE'RE BUILDING.

UH, WE ATTEMPTED TO ANSWER ALL THEIR QUESTIONS.

THEY MAY STILL HAVE SOME REMAINING, BUT WE WILL, AS PART OF OUR PLAN, WE WILL HAVE A 20 FOOT LANDSCAPE BUFFER THAT WILL ABUT THEIR PROPERTY.

UH, WHAT WE DID COMMIT TO AT THAT MEETING WAS TRYING TO BALANCE BETWEEN THE REQUIRED LANDSCAPE BUFFER AND THE REQUIRED REAR YARD DRAINAGE AND LEAVING THE FIRST FIVE OR 10 FEET ON THE TREE LINE, THAT WHERE THE TREES ARE ACTUALLY EMBEDDED IN THE FENCE SO THAT WE DON'T HAVE TO MESS WITH THEIR FENCE.

UH, WHILE AT THE SAME TIME, WE STILL MAINTAIN

THE MATURE TREES THAT ARE BACK THERE.

SO WE DON'T HAVE TO TAKE THEM ALL DOWN BECAUSE THERE IS A PORTION OF THE NORTHERN PROPERTY LINE OR OUR PROPERTY LINE THAT IS TREED.

SO WE DID COMMIT TO, YOU KNOW, GOING AHEAD AND SAVING WHAT DIDN'T INTERFERE WITH INSTALLING PROPER DRAINAGE, BECAUSE WE FELT LIKE THE DRAINAGE KIND OF SUPERSEDES THE NEED FOR SAVING THE TREES.

THE SPRINTING IS VERY IMPORTANT THESE DAYS.

WE ARE ALSO AWARE THAT NOT AWARE, BUT WE HAVE BEEN WORKING WITH THE CORPS OF ENGINEERS.

THERE IS A PORTION OF OUR SITE IN THE SOUTHEAST CORNER WHERE OUR FUTURE DETENTION POND IS GOING TO BE LOCATED THAT THERE ARE SOME WETLANDS DOWN THERE.

WE ARE IN THE MIDDLE OF THE PERMITTING PROCESS, BUT THE CORPS OF ENGINEERS ARE FULLY AWARE OF THAT PROCESS AND HOW IT WORKS.

IT COMES ABOUT ON A LOT OF OUR PROJECTS.

UH, SO WE DO GO THROUGH IT OFTEN.

IT TAKES ABOUT 12 TO 18 MONTHS TO GET THROUGH THAT ENTIRE PROCESS.

AND AS A PART OF THAT PROCESS, YOU HAVE TO HAVE APPROVAL OF A PRELIMINARY PLAT OR SOME KIND OF PLAN WITH CITY PARISH.

SO THAT'S THE STAGE WE'RE AT RIGHT NOW, BUT WE HAVE INITIATED THAT PROCESS AND WE ARE GOING, GOING THROUGH IT.

UH, I GUESS IN SUMMARY, WHAT I WOULD LIKE TO JUST REITERATE IS THAT THIS IS A DOWN'S ZONING FROM C2 TO EIGHT, 2.5.

IT IS GOING TO BE ADJACENT TO INTERESTINGLY ENOUGH, TO SOME, SOME AWAN SINGLE FAMILY THAT'S LOCATED ON C2 PROPERTY BACK IN THE MID NINETIES.

UH, THERE WERE SOME PROPERTIES THAT WERE ALLOWED TO BUILD SINGLE FAMILY ON C2 THOUGH.

THE PROPERTY TO THE NORTH AND THE WEST OF US IS ACTUALLY ZONE C TWO, EVEN THOUGH IT HAS A SINGLE FAMILY RESIDENTIAL.

SO OUR REZONING, OUR DOWN ZONING WOULD BE MORE COMPATIBLE WITH THAT.

PELICAN LAKES HAS BEEN A PUD.

THAT'S BEEN IN THE WORKS SINCE 2004.

THIS IS THE FINAL PART IN 17 LOTS.

AND IT'S LOCATED ON 33 ACRES.

UM, ONE OF THE REASONS THAT WE DEPARTED LAST MONTH IS THAT THE DEPARTMENT OF DEVELOPMENT ASKED US TO GO BACK AND RE REVIEW THE DRAINAGE FOR THE ENTIRE DEVELOPMENT.

ALTHOUGH THIS WAS ONLY A VERY SMALL PORTION OF IT.

THEY WANTED US TO GO BACK AND LOOK AT THE DRAINAGE FOR THE ENTIRE 153 ACRES.

SO WE DID THAT.

WE TOOK AN EXTRA TWO MALLS AND WE WENT AHEAD AND TOOK A LOOK AT TO MAKE SURE THAT EVERYTHING THAT WAS DESIGNED IN 2004, NOT ONLY WAS IT BUILT UP, BUT IT WAS BUILT PROPERLY.

AND THAT THIS FINAL PHASE COULD ACCOMMODATE THAT.

WE ALSO HAD TO TAKE THIS FINAL PHASE AND MEET THE NEW STRICTER REQUIREMENTS FOR OUR DEVELOPMENT AND FLOOD ZONE.

SO AS A PART OF THAT DRAINAGE STUDY, WE ALSO LOOKED AT THE SIX FILING MEETING THOSE REQUIREMENTS.

AND THE ONLY THING I WANT TO SAY ABOUT THE DRAINAGE STUDY WAS THAT THE ORIGINAL 2004 DRAINAGE STUDY SHOWED ABOUT 16 ACRES OF DETENTION.

ULTIMATELY, WE ENDED UP WITH ABOUT 31 ACRES OF DETENTION OUT THERE.

WE WERE ABLE TO TAKE THE 10 YEAR STORM AND REDUCE THE FLOW ONTO BURBANK BY 42%, THE 25 YEARS STOLEN.

WE REDUCED IT BY 39% AND THE A HUNDRED YEAR STORM, WE REDUCED THE FLOW INTO BURBANK BY 36%.

SO THE DEVELOPMENT IS WORKING AS IT WAS INTENDED TO IT'S PROVIDING A DRAINAGE BENEFIT FOR THE BAYOU FOUNTAIN WATERSHED.

UH, THIS IS A USE BY RIGHT, THAT'S CONSISTENT WITH THE APPROVED AND SET CONCEPT PLAN.

SO WE'D ASKED FOR YOUR APPROVAL.

UH, THE INFORMATION FOR TODAY SAYS A HUNDRED PERCENT IS IN THE SPECIAL FLOOD HAZARD AREA AT THAT POINT, UH, 36 30 0.6 ACRES OF REQUIRED FOR COMMON OPEN SPACE.

AND THAT WAS PROVIDED WITH A FURTHER DESCRIPTION THAT ABOUT 50% OF THAT UP TO 50% MIGHT WOULD BE NATURAL WETLANDS

TODAY ON THE FORM ON THE WEBSITE UNDER COMMON OPEN SPACE REQUIRED, IT SAYS NO ANSWER.

AND 10.6 ACRES IS PROVIDED UNDER GREEN OPEN SPACE.

THEY WERE PROVIDING 21.2 ACRES, UH, TODAY.

UM, THE DISCREPANCIES BETWEEN THE PREVIOUS SUBMITTAL, WHICH WAS A CONCEPT PLAN REVISION, UM, FOR THE ENTIRE SITE THAT WERE REVISING THE USE TABLE.

SO THAT STAFF REPORT HAD THE ACREAGE AND OPEN SPACE, UH, AND LANDSCAPE AND DETENTION FOR THE ENTIRE SITE WHERE THIS IS A FINAL DEVELOPMENT PLAN AS THE APPLICANT STATED FOR THE LAST PHASE OF THE DEVELOPMENT.

UM, SO TH THOSE ARE THE REASONS FOR THE DISCREPANCIES ON THE STICK, UH, STAFF REPORT.

IT WAS APPLES AND ORANGES.

IT WAS TWO DIFFERENT TWO DIFFERENT DEVELOPMENTS.

UH, ONE WAS THE CONCEPT PLAN WHERE THIS IS A FINAL DEVELOPMENT PLAN ON JUST THE PORTION, AS FAR AS THE CASE HISTORY, THAT PREVIOUS CONCEPT PLAN DID COME BEFORE THIS BODY IN DECEMBER OF 2021 STAFF DID CERTIFY THAT IT STOOD ON ITS OWN MERITS.

IT WAS CONSISTENT WITH THE UNIFIED DEVELOPMENT CODE.

HOWEVER, BASED ON PUBLIC TESTIMONY, UH, THE PLANNING COMMISSION SENT IT TO THE COUNCIL AS A DENIAL, UH, COUNCIL THEN APPROVED IT, UH, WHICH THEY HAVE THE ABILITY TO DO COUNCIL, UH, APPROVE THAT CONCEPT OF PLAN CHANGE AT THEIR JANUARY MEETING EARLIER THIS YEAR.

SO THIS IS SIMPLY A FINAL DEVELOPMENT PLAN THAT IS ENTIRELY CONSISTENT WITH WHAT THE COUNCIL APPROVED.

IT IS A 117 SINGLE FAMILY, LOT SUBDIVISION, AND, UM, IT MEETS THE MERITS OF THE DRAINAGE, UH, REQUIREMENT AND THE ORDINANCE WITH THE ENHANCED HUNDRED YEAR DESIGN REQUIREMENT AND, UH, GREATLY EXCEEDS THE MINIMUM, UM, DRAINAGE AND, AND DETENTION AREAS.
