IT WAS ESTABLISHED IN JUNE OF 1984.

IT IS A 171 LOT SUBDIVISION AND ALL BUT THREE LOTS HAVE HOMES ON THEM.

ALL OF THE HOMES ARE SINGLE FAMILY DWELLINGS.

WE WERE, THE ASSOCIATION WAS INCORPORATED IN APRIL, 1987.

IN APRIL, 2022, A NEIGHBOR, RESIDENT, NEIGHBORHOOD RESIDENT INFORMED THE BOARD THAT A HOUSE IN OUR SUBDIVISION WAS LISTED ON AIRBNB.

IT RENTS FOR $1,250 PER NIGHT.

AND EVEN THOUGH IT IS A FOUR BEDROOM, TWO AND A HALF BATH HOUSE, THE HOST ON THE SITE REPRESENTS THAT UP TO 15 GUESTS CAN STAY THERE.

THE OWNER DOES NOT LIVE IN THE HOUSE AND GUESTS SELF CHECK IN USING A KEYPAD.

I HAVE A COPY OF THE AIRBNB LISTING.

I'VE PROVIDED IT TO OUR COUNCIL, UH, UH, MEN, UH, GO DAY.

BUT I HAVE THAT IF, IF WE NEED TO, UH, PUT THAT IN THE RECORD.

THE OWNER PARKING BY GUEST IS ENCOURAGED ON THAT LISTING IN THE TWO CAR GARAGE IN THE DRIVEWAY AND ON THE STREET.

WE'VE BEEN ADVISED BY AN ATTORNEY THAT THIS USE IS NOT CLEARLY IN VIOLATION OF OUR APPLICABLE RESTRICTIVE COVENANTS.

WE HAVE FOUR FILINGS, OUR RESTRICTIVE COVENANTS OR A LITTLE BIT DIFFERENT FOR EACH FILING.

BUT LET ME JUST TELL YOU THAT OUR, THE FIRST FILING RESTRICTIONS FOR THIS LOT SAYS ALL OF THE LOTS CONTAINED IN THIS SUBDIVISION ARE DESIGNATED AS RESIDENTIAL, AND THEY SHALL BE USED FOR NONE OTHER THAN RESIDENTIAL PURPOSES.

NO BUILDING SHALL BE ERECTED, ALTERED PLACE, OR PERMITTED TO REMAIN ON ANY LOT OTHER THAN ONE SINGLE FAMILY DWELLING.

I'VE BEEN AT IN PARK FOREST FOR APPROXIMATELY 28 YEARS, AND I'M ACTIVE WITH THE COMMUNITY ASSOCIATION AS WELL AS THE CRIME DISTRICT, UH, EVER SINCE ITS INCEPTION APPROXIMATELY 10 YEARS AGO.

UM, OUR GOAL IS TO KEEP OUR, MAINTAIN OUR, OUR COMMUNITY CLEAN AND SAFE.

WE HAVE ONE SHORT TERM RENTAL IN THE NEIGHBORHOOD THAT HAS BEEN THE SOURCE OF MULTIPLE COMPLAINTS TO THE PARK FOREST HOTLINE.

THE COMPLAINTS COME MOSTLY ON THE WEEKENDS AND CONSISTS OF ONE ILLEGAL PARKING TO THE POINT THAT THE NEIGHBORS ARE HAVING DIFFICULTY GETTING IN AND OUT OF THEIR OWN DRIVEWAYS.

THERE ARE MANY CARS PARKED ON THE STREET, USUALLY IN THE WRONG DIRECTION, AS WELL AS LARGE OVERSIZED TRUCKS SUCH AS TOW TRUCK.

B R P D HAS BEEN CONTACTED ON SEVERAL OCCASIONS AND USUALLY STATE THAT THERE IS NOTHING THAT THEY CAN DO EVEN WHEN THE CARS ARE PARKED ON THE WRONG SIDE OF THE STREET.

OR THERE ARE OVERSIZED VEHICLES, WHICH OBVIOUSLY VIOLATES PARKING ORDINANCES.

THERE ARE STRANGERS WALKING ALONG THE STREETS IN THE, IN THAT AREA AT ALL TIMES OF THE NIGHT.

THERE'S LIGHTING AT THE BUSINESS INDICATING THAT IT IS A BUSINESS.

THE ORDINANCE PROHIBITS PLACING SIGNS OR ANYTHING THAT INDICATES THAT THERE IS A BUSINESS IN A SINGLE FAMILY DWELLING.

HOWEVER, THIS LIGHTING CONSISTS OF RED, YELLOW, AND BLUES SPOTLIGHTS ALONG WITH MULTIPLE FLAGS.

IT'S QUITE BRIGHT AT NIGHT.

MULTIPLE COLORS ON A HOME WITH LIGHTING IS GREAT DURING THE HOLIDAY SEASONS.

HOWEVER, NO ONE WANTS TO LIVE IN THIS VICINITY WITH THOSE LIGHTS ON ALL NIGHT LONG.

THE PARKING CAN BE HANDLED BY B R P D, HOWEVER, THE ISSUE OF STRANGERS AND LIGHTINGS CANNOT BE HANDLED.

THERE ARE NO ORDINANCES AS FAR AS WE KNOW THAT CAN ADDRESS THESE ISSUES.

PLEASE CONSIDER REVIEWING THE ORDINANCE AS IT IS NOW, AND INCLUDE LANGUAGE TO INHIBIT OR AT LEAST RESTRICT SOME OF THE ACTIVITIES THAT I HAVE OUTLINED.

WE ARE ALSO VERY CONCERNED ABOUT THE ENFORCEMENT OF THIS ORDINANCE.

IT IS STATED THAT B R P D WILL BE IN CHARGE OF ENFORCEMENT AS STATED.

B R P D ALREADY HAS BEEN CALLED OUT AND SAYS THAT THERE IS NOTHING THAT THEY CAN DO TO ENFORCE THE ORDINANCES THAT ARE ALREADY IN EXISTENCE.

HOW CAN WE EXPECT THEM TO ENFORCE THESE ORDINANCES IN ADDITION TO THE PROBLEMS THAT THEY'RE ALREADY SEEING IN ADDRESSING IN AND AROUND BATON ROUGE? WE ARE, WE APPLAUD THOSE WHO DID COME UP WITH THIS ORDINANCE AND IN AN ATTEMPT TO MAKE SOME CHANGES AND TO HELP US TO MANAGE B AND B, UH, THESE SHORT-TERM RENTALS IN OUR NEIGHBORHOOD.

BUT MAYBE THERE'S ANOTHER SOURCE OF ENFORCEMENT LIKE MAYBE THREE OH, USING THE THREE 11 CALL CENTER WITH AN ENFORCEMENT OFFICER FOR THE STRS.

WE CURRENTLY DON'T HAVE ANYTHING, AND THAT'S WHAT ALL OF THIS, UH, STUDY AND DISCUSSION IS ABOUT.

AND, UH, SOME OF, UH, MY CLIENTS ARE TELLING ME THAT THEY HAVE OVERSIGHT WITH AIRBNB AND SOME OTHER ORGANIZATIONS THAT, UH, OVERSEE THE SHORT TERM RENTAL PROPERTIES AND THEY HAVE STRICT RULES AND REGULATIONS, WHICH TO WHICH THEY HAVE TO COMPLY OR THEY WILL BE SHUT DOWN WITH BY THEM RATHER.

AND RATHER THAN JUST WAIT FOR THIS TO, TO TRANSPIRE.

UH, AND JUST FROM A POSITIVE STANDPOINT, MANY, UM, SHORT TERM RENTAL GUESTS HAVE SENT, UH, VERY GLOWING RECOMMENDATIONS AND, UM, ABOUT HAVING THESE AVAILABILITIES TO STAY WITHIN CERTAIN AREAS OF TOWN RATHER THAN ON THE, UH, INTERSTATE OR DOWNTOWN IN HOTELS.

AND IT AFFORDS THEM THE OPPORTUNITY TO EXPERIENCE, UM, MID CITY, UM, RE UH, UM, SHOPPING AND THINGS LIKE THAT THAT, THAT THEY WOULDN'T KNOW NORMALLY BE ABLE TO EXPERIENCE JUST IF THEY STAYED AT A HOTEL.

AND IT GIVES 'EM A HOME TYPE, UM, ENVIRONMENT

AND THEY WENT THROUGH ALL THE PROCESSES, BUT THEY WERE HAVING A STRIP, A STRIP DEAL IN ON THE WEEKENDS.

THEN THERE'S ANOTHER ONE WHERE THE AUNT WAS RENTING FROM.

BUT IF THEY HAD TO GO THROUGH THIS PROCESS, THAT WOULD'VE BEEN ELIMINATED CUZ YOU CAN'T CATCH EVERYTHING.

THERE'S ANOTHER WHERE THE AUNT WAS LIVING IN A RENTAL AND THE AUNT DIED AND THE, THE NEPHEW NEVER SAID, TOLD THE OWNERS AND THEY WERE OUTTA STATE AND HE WAS RENTING IT OR, UH, AIRBNB, THE HOME IS, SO THIS NOT BECAUSE OF PARK NECESSARILY PARKING, CUZ THEY'RE IN MY SUBDIVISION.

THE POLICE DON'T DO ANYTHING FOR PEOPLE PARKING.

SO IT WAS, IT'S BASICALLY TO PROTECT YOU BECAUSE IT, OR PROTECT OWNERS AND MAKE SURE THAT IT'S FAIR.

BECAUSE IF YOU HAVE, UM, AN OCCUPIED AND SOMEONE HAS AN UNOCCUPIED, THEY'RE GETTING MORE REVENUES AND NOT PAYING TAXES, YOU GETTING LESS REVENUES AND NOT PAYING TAXES OR NOT GETTING THE PROPER LICENSES.

SO FOR, FOR THIS, IT IS, AND IF YOU ALL HAVE A PLAN AND YOU THINK IT'S GOOD TO ME, I WOULD COMPARE THE PLANS THAT I HAVE AGAINST THIS AND SEE IF THERE'S SOMETHING THAT IS, UM, IF OVER AND THEN YOU HAVE A REAL CONVERSATION.

BUT CHANCES ARE THERE'S NOTHING DIFFERENT FROM WHAT YOU HAVE, YOU ALL ARE ALREADY DOING.

SO I DO SUGGEST IN THIS 30 DAYS THAT YOU READ IT AND KNOW THAT THIS HAS, THIS IS IN NO WAY DOING ANYTHING BUT MA BASICALLY PUTTING MANDATES ON THAT DISTINGUISH OCCUPIED AND UNOCCUPIED.

IF YOU LOOK AROUND THE COUNTRY, MANY CITIES AND MUNICIPALITIES ARE TACKLING THIS ISSUE, DRAFTING ORDINANCES AND LEGISLATIONS TO MANAGE THIS, WHAT I CALL A INTERRUPTION OF THE THE MARKET, UM, WHICH IS, WHICH IS GOOD, IS INNOVATION.

SO I SUPPORT AIRBNBS.

UH, TWO THINGS I HEARD FROM, FROM THE AUDIENCE.

UM, THE NEIGHBORHOOD ASSOCIATION FOLKS AND RESIDENTS CAN HAVE CONCERNS ABOUT PARKING AND NO RESTRICTIONS, NO LANGUAGE AS IT RELATES TO RESTRICTIONS IN PARKING, UH, IN THIS ORDINANCE.

SO IN THESE 30 DAYS, I WOULD ENCOURAGE US TO LOOK AT THAT AND SEE IF WE CAN IMPLEMENT THAT IN THE, IN THE LANGUAGE.

WHAT I ALSO HEARD FROM THE AIRBNB OWNERS IS THEY DIDN'T HAVE ANY ISSUES WITH THAT.

THEY, THEY WELCOME, YOU KNOW, THAT TYPE OF LANGUAGE.

SO I DIDN'T SEE ANY OBJECTION THERE.

UM, THE OTHER THING I SAW AND HEARD AND COUNCILWOMAN, I THINK THIS IS WHERE THE OWNERS HAVE

UH, IN THE ORDINANCE, IT REQUIRES, UH, NONE ON OCCUPIED OPERATORS UPON A SECOND, UH, PROPERTY TO GO BEFORE PLANNING AND ZONING AS IF A BAR WOULD GO TO APPLY FOR A LIQUOR LICENSE OR ANY REZONING.

CURRENTLY THAT IS NOT THE CASE.

AND I WANT YOU TO KIND OF CLARIFY THEM REFERENCING IT AS THEM BEING SEEN AS A HOTEL VERSUS WHAT WHAT WE'RE SEEING.

IS IT THE SAME CRITERIA, SIMILAR CRITERIA OR IS ARE, ARE THEY, UH, CONFUSED IN THAT? YEAH, THERE'S BEEN A LOT OF MISUNDERSTANDING AND, AND MISREPRESENTATION OF WHAT THIS IS AND WHAT THIS ISN'T.

UM, COUNCILMAN TO ANSWER YOUR QUESTION, THIS IS NOT A REZONING TO REZONE THESE PROPERTIES TO, TO HOTEL STANDARDS OR HOTEL ZONING.

THIS DOESN'T INTRODUCE HOTELS IN THE MIDDLE OF NEIGHBORHOODS.

WHAT THIS ORDINANCE DOES IS ATTEMPT TO CREATE GENERAL BASIC REGULATIONS IN AN UNREGULATED MARKET HERE IN BATON ROUGE.

AS YOU MAY KNOW, MANY CITIES ACROSS THE COUNTRY HAVE DEALT WITH SHORT TERM RENTALS, UH, FOR MANY YEARS NOW AND HAVE CREATED AN ORDINANCE.

SOME ARE BASIC, SOME ARE QUITE ADVANCED AND, UH, AND, AND DIFFICULT TO NAVIGATE THROUGH.

THIS WAS AN ATTEMPT, UM, TO CREATE A BASIC FRAMEWORK TO WORK WITHIN, UH, THE WORKING GROUP THAT WAS COMPRISED OF, UH, THE PLANNING COMMISSION STAFF, THE PERMITTING OFFICE STAFF, THE FEDERATION OF GREATER BATON ROUGE CIVIC ASSOCIATIONS, THE BOARD OF REALTORS, THE BATON ROUGE LODGING ASSOCIATION, THE BED AND BREAKFAST ASSOCIATION, A REPRESENTATION FROM, UH, A HISTORIC NEIGHBORHOOD IN SPANISH TOWN.

THIS IS WHERE THIS ISSUE ORIGINATED.

UH, AN AIRBNB HOST AND A REPRESENTATIVE FROM AIRBNB.

THEY ATTENDED A SERIES OF MEETINGS.

WE HAD ABOUT 10 TO 12 MEETINGS IN THE LAST 12 OR UH, 18 MONTHS.

WE'VE HAD EVERY DRAFT ON OUR WEBSITE.

WE PRESENTED THIS ITEM TO THE, UH, FEDERATION AT THEIR, AT THEIR, UH, BOARD MEETING.

WE, UH, HAVE MET WITH ANYONE WHO'S WHO'S ASKED US TO MEET WITH THEM.

WE'VE, UM, TAKE, TOOK MANY CALLS, ANSWERED MANY EMAILS.

UH, WE'VE BEEN AS, AS TRANSPARENT AS POSSIBLE, BUT I DO UNDERSTAND THERE'S PEOPLE JUST NOW HEARING ABOUT THIS AND WE'LL BE HAPPY TO, TO MEET WITH THEM IN THE NEXT 30 DAYS.

BUT, UM, AGAIN, THIS WAS THE GOAL WAS TO CREATE A LEVEL PLAYING FIELD.

THERE'S, THERE'S BASIC REGULATIONS RIGHT NOW, UH, FOR BED AND BREAKFASTS, FOR LODGING HOUSES, ALL OF WHICH ARE ALLOWED IN RESIDENTIAL ZONING DISTRICTS.

MANY NEIGHBORHOODS HAVE NO PROBLEM WITH SHORT TERM RENTALS, HOWEVER, IT'S, IT'S NOT FOR EVERY NEIGHBORHOOD.

UM, THIS, THE BIGGEST ISSUE WAS CREATING TWO CATEGORIES.

OWNER OCCUPIED THE WORKING GROUP FELT THAT IF THE OWNER WAS ON THE PREMISES AND COULD MANAGE THE PROPERTY AND THERE WOULD BE A POINT PERSON TO TALK TO FOR THE NEIGHBORHOOD AND THE ADJACENT NEIGHBORS, THEY DIDN'T SEE ANY ISSUE WITH THAT.

THERE'S VERY MINIMAL, UH, REGULATIONS.

THERE'S NO PUBLIC HEARINGS, THERE'S NO REZONINGS, THERE'S NO COMING BEFORE A, A PUBLIC BODY ASKING FOR APPROVAL.

UH, BASICALLY YOU PAY A WHAT AMOUNTS TO A $65 REGISTRATION PERMIT FEE, YOU'RE GOOD TO GO.

THE EXISTING ONES ARE ALL GRANDFATHERED IN.

THE OTHER SIDE OF IT, UH, WAS WHERE THE ISSUE WAS.

WE SPENT A LOT OF TIME ON ON HOW TO CLASSIFY AND WORK OUT REGULATIONS FOR WHAT THE GROUP FELT WAS A BIGGER ISSUE AND THAT WAS THE NON OWNER OCCUPIED.

AGAIN, I UNDERSTAND MOST OF 'EM ARE GOOD OPERATORS.

UM, THERE'S NO ISSUES, BUT THE PARTY HOUSE THING JUST KEPT COMING UP AND, AND THEY'RE OUT THERE NOW.

UM, THEY'RE NOT EVERYWHERE, BUT THERE ARE NEIGHBORHOODS THAT ARE AFFECTED BY THAT.

SO THAT THIS WAS AN ATTEMPT TO CREATE SOME A, A FRAMEWORK AND AND REGULATIONS FOR NEW NON-OWNER OCCUPIED, UM, PROPERTIES.

THEY MAY BE INVESTMENT PROPERTIES, PEOPLE OUTTA TOWN, OUTTA STATE THAT BUY THESE.

AGAIN, A LOT OF THEM ARE, ARE GOOD OPERATORS, BUT THIS WOULD PROVIDE A FRAMEWORK FOR, FOR MAYBE THE NOT SO GOOD OPERATORS OR NEIGHBORHOODS THAT WEREN'T COMFORTABLE WITH IT TO HAVE A VOICE AND, AND COULD COME TO THE TABLE AND, AND, AND ESSENTIALLY COME BEFORE THE PLANNING COMMISSION.

AND IF IT WASN'T A GOOD FIT FOR THAT NEIGHBORHOOD OR THIS OPERATOR IN PARTICULAR HAD A HISTORY OF, UH, COMPLAINTS, THE PLANNING COMMISSION MAY CHOOSE TO DENY THAT.

AND, AND THAT WAS THE FRAMEWORK THAT THE WORKING GROUP CAME UP WITH.
