CONSIDER A PETITION OF APPEAL ON BEHALF OF THE MICHAEL ROBERTSON TO SET AN APPEAL HEARING FOR NOTICE OF RULING.MR. CHAIR, THIS IS A PETITION FOR APPEAL THAT HAS COME IN AND TYPICALLY WE WOULD SCHEDULE IT, BUT I KNOW THERE'S SOME ISSUES THAT THE LAWYERS WANNA DISCUSS WITH THE BOARD, SO I'M GONNA DEFER TO MR. DEWEY AT THIS POINT THAT THAT'S CORRECT.
UH, WE HAVE HAD SOME PREVIOUS DISCUSSIONS VIA EMAIL BASED ON, UH, WHEN MR. ROBERTSON CAME TO ME TO REPRESENT HIM ON THIS MATTER.
THERE HAVE BEEN SOME CRIMINAL CHARGES THAT ARE FILED.
SO BASED ON THAT, WE WOULD BE ASKING FOR A STAY.
'CAUSE THIS MAY RESOLVE ITSELF ON ITS OWN VOLITION WITH THE CRIMINAL CHARGES, EITHER BY ABSOLUTION OR BY PLEA OR CONVICTION.
SO WE WOULD ASK FOR, I THINK IT WOULD BE REASONABLE TO STAY FOR SIX MONTHS AND WE CAN REVISIT TO SEE WHERE IT'S AT THIS TIME FOR JUDICIAL EFFICIENCY INSTEAD OF HAVING TO HEAR IT AND THEN REVISIT IT WITH THE CRIMINAL PROCEEDING ONGOING.
AND I THINK MR. RAINS AND THE BO UH, BOARD ATTORNEY, WE'RE IN AGREEMENT ON THAT MATTER? THAT'S CORRECT.
AND THAT, IN THAT CASE THEN, UM, WE WANT TO TURN TO THE RESCHEDULE THEN FOR SIX MONTHS IS THAT WE WOULD NEED A MOTION TO STAY THIS MATTER, UH, FOR RECONSIDERATION IN SIX MONTHS.
I MOVE TO STATE, UH, UH, THIS MOTION FOR SIX MONTHS WHERE WE CAN REVISIT.
THERE'S NO OTHER ITEMS TO COME BEFORE THE BOARD.
