ARE THERE ANY MEMBERS OF THE PUBLIC WHO WOULD LIKE TO SPEAK ON ANY ITEM FROM THE CONSENT AGENDA AND IT'S AN ITEM THAT HASN'T ALREADY BEEN PULLED.
OKAY, WELL WE'VE ALREADY PULLED IT.
THIS IS TO SEE IF THERE WERE ANY ADDITIONAL ITEMS SIR.
OKAY, SEEING NONE IS THERE A MOTION? COMMISSIONER ADDISON.
ARE THERE ANY OBJECTIONS TO ACCEPTING THE ITEMS THAT HAVE BEEN PLACED ON THE CONSENT AGENDA? SEEING NONE OF THOSE ITEMS HAVE BEEN APPROVED THEN WE CAN NOW MOVE
[2. Case 37-24 2327 O’Neal Lane (Deferred from August 19 by the Planning Commission)]
ON TO THE REGULAR AGENDA.WE'LL BEGIN WITH ITEM NUMBER TWO, CASE 37 24 23 27 O'NEILL LANE CASE 37 24 23 27 O'NEILL LANE.
PROPERTY IS LOCATED AT THE SOUTHEAST INTERSECTION OF O'NEAL LANE AND BRISTOW AVENUE COUNCIL DISTRICT NINE HUDSON.
THE APPLICANT IS HOWARD R HICKS JR.
FUTURE VR LAND USE DESIGNATION IS MIXED USE.
THE EXISTING ZONING IS LIGHT COMMERCIAL C ONE BUT THE REQUESTED ZONING OF HEAVY COMMERCIAL ONE HC ONE CASE 37 24 23 27 O'NEILL LANE.
STAFF CERTIFIES THAT THE PROPOSED REQUEST MEETS THE CRITERIA FOR A CHANGE OF ZONING BEING CONSISTENT WITH THE COMPREHENSIVE PLAN, COMPATIBLE WITH SURROUNDING USES AND CONFORMING TO THE UNIFIED DEVELOPMENT CODE REQUIREMENTS.
THIS ITEM WAS DEFERRED FROM LAST MONTH'S PLANNING COMMISSION MEETING DUE TO CONCERNS FROM THE ADJACENT SUBDIVISION.
COUNCILMAN HUDSON MET WITH RESIDENTS AND STATED THAT THE MAJORITY OF THE RESIDENTS HE MET WITH WERE OKAY WITH THE REZONING REQUESTS AND HE HAD NO OBJECTIONS TO THIS ITEM.
OKAY, COMMISSION MEMBERS AT THIS TIME I'LL OPEN THE PUBLIC HEARING AND INVITE THE APPLICANT TO SPEAK FOR A PERIOD NOT TO EXCEED 15 MINUTES.
[00:10:01]
DIRECTOR HOLCOMB.WE DON'T HAVE ANY SPEAKER COURTS FOR THIS ITEM, IS THAT CORRECT? NO ADDITIONAL SPEAKER COURTS.
OKAY, JUST WANTED TO LET YOU KNOW THAT SIR.
WE WILL BE THE CIVIL ENGINEERS FOR THIS PROJECT AND AS UM, AS MENTIONED SUMMARIZED A MINUTE AGO, WE, OUR REQUEST IS TO REZONE FROM C ONE TO HC ONE, UM, TO ALLOW FOR OUR PROPOSED USE AND UM, AS ALSO MENTIONED WE WERE DEFERRED AT THE LAST MEETING AND SINCE THEN WE'VE HAD A NEIGHBORHOOD MEETING AND ALLEVIATED AND APPEASED A LOT OF CONCERNS FROM THE SURROUNDING PROPERTY OWNERS.
SO I'M HERE TO ANSWER ANY QUESTIONS THAT PUBLIC OR COMMISSION MEMBERS MAY HAVE AND UM, THAT'S ALL.
AT THIS TIME I WILL CLOSE THE PUBLIC HEARING AND INVITE ANY QUESTIONS OR COMMENTS OR MOTIONS FROM THE COMMISSION.
I BELIEVE THERE'S A MOTION ON THE FLOOR TO APPROVE THIS ITEM FROM COMMISSIONER ADDISON.
I BELIEVE THAT MOTION RECEIVED A SECOND FROM VICE CHAIRMAN GROUT.
ARE THERE ANY OBJECTIONS OR ANY NEED FOR FURTHER DISCUSSION? SEEING NONE, THAT ITEM HAS BEEN APPROVED AT THIS TIME.
[3. CONSENT FOR APPROVAL Case 38-24 110 North Baxter Street]
ON TO ITEM NUMBER THREE.CASE 38 24 1 10 NORTH BAXTER STREET CASE 38 24 1 10 NORTH BAXTER STREET.

THE PLANNING COMMISSION STAFF CERTIFIES THAT THE PROPOSED REZONING REQUEST MEETS THE CRITERIA FOR A CHANGE OF ZONING BEING CONSISTENT WITH THE COMPREHENSIVE PLAN, COMPATIBLE WITH SURROUNDING USES AND CONFORMING TO THE UNIFIED DEVELOPMENT CODE REQUIREMENTS.
AT THIS TIME I'LL OPEN THE PUBLIC HEARING AND INVITE THE APPLICANT TO SPEAK FOR A PERIOD NOT TO EXCEED 15 MINUTES.
IS THE APPLICANT PRESENT? UM, I SPENT SOME TIME RESTORING THIS HOUSE.
UH, THE WOMAN WHO'S RENTING FROM ME, SHE WANTS TO BE A FIRST TIME HOMEOWNER AND I CAN'T SELL IT TO HER IF IT'S COMMERCIAL, SO.
WE HAVE ONE OTHER SPEAKER CARD THAT IS IN OPPOSITION BUT DOES NOT WISH TO SPEAK AND THAT CARD IS FOR MARGARET NETTLES.
DO YOU LIKE TO SPEAK? YOU CAN COME TO THE PODIUM NOW.
THE REZONING THAT WE'RE DOING HERE, YOU'RE GONNA REZONE IT TO MAKE IT STRICTLY FOR COMMERCIAL OR IS THIS GONNA BE RESIDENTIAL OR HOW IS THIS GONNA AFFECT THEIR RESIDENTIALS THAT'S THERE? SO THIS IS A DOWN ZONING.
IT'S GETTING RID OF THE COMMERCIAL ZONING AND THEY'RE ASKING FOR A RESIDENTIAL ZONING CATEGORY.
OKAY, SO IT'LL BE STRICTLY RESIDENTIAL AND NON-COMMERCIAL, CORRECT? THAT'S CORRECT.
UH, UNLESS THE APPLICANT FEELS A NEED TO COME BACK TO THE PODIUM, YOU DON'T HAVE TO THEN I'LL CLOSE THE PUBLIC HEARING AND INVITE ANY QUESTIONS, COMMENTS, OR MOTIONS FROM THE COMMISSIONER? THERE'S A MOTION ON THE FLOOR FROM COMMISSIONER ADDISON TO APPROVE THIS ITEM.
IS THERE A SECOND? SECOND FROM COMMISSIONER BOYD.
ARE THERE ANY OBJECTIONS? ANY FURTHER DISCUSSION? SEEING NONE, THAT ITEM IS APPROVED AT THIS TIME.
[12. CONSENT FOR APPROVAL PUD-14-06 Mickens Road, Concept Plan Revision 3]
MOVE ON TO ITEM NUMBER 12.PUT 1406 KINS ROAD CONCEPT PLAN REVISION THREE.
PUT PUD 1406 KINS ROAD CONCEPT PLAN REVISION THREE.
PROPERTY IS LOCATED ON THE SOUTH SIDE OF KINS ROAD, WEST OF JAW ROAD COUNCIL DISTRICT FIVE HEARST.
THE APPLICANT IS CHAD STEVENS.
FUTURE B LAND USE DESIGNATION IS COMPACT NEIGHBORHOOD, RESIDENTIAL NEIGHBORHOOD AND NEIGHBORHOOD CENTER.

PUD 1406 KINS ROAD CONCEPT PLAN UNDER DIVISION THREE PLANNING COMMISSION.
STAFF CERTIFIES THAT THE PROPOSED REQUEST MEETS THE MINIMUM CRITERIA OF THE PLANNED UNIT DEVELOPMENT BEING CONSISTENT WITH THE COMPREHENSIVE PLAN, COMPATIBLE WITH SURROUNDING USES AND ALSO CONFORMING TO THE UNIFIED DEVELOPMENT CODE REQUIREMENTS COMMISSION MEMBERS.
AT THIS TIME I OPEN THE PUBLIC HEARING AND INVITE THE APPLICANT TO SPEAK FOR A PERIOD 19 C 15 MINUTES.
MEMBERS OF COMMISSION, ERIC PIAZZA REPRESENT THE APPLICANT.
[00:15:01]
IS AN EXISTING PUD.THIS IS NOT, THIS IS NOT A NEW APPROVAL.
IT'S AN EXISTING PUD AND ON THIS EXISTING PUD THERE WAS CURRENTLY 19.1 ACRES OF COMMERCIAL PROPERTY.
WE ARE CHANGING THE PUD TO REDUCE THE 19.1 ACRES OF COMMERCIAL TO 15.1 ACRES OF COMMERCIAL AND THEN THERE'LL BE TOWN HOMES ON THE OTHER FOUR ACRES.
THIS PROCESS HAS BEEN VETTED THROUGH COUNCILMAN HURST.
HE'S AWARE OF IT, HE SUPPORTS IT.
UM, MR. HOLCOMB AND I BOTH MET WITH HIM TO, TO TALK TO TALK ABOUT THIS, MAKE SURE THERE WOULD NOT BE ANY MULTIFAMILY, WHICH IS REFLECTED ON THE NEW PUTT AMENDMENT.
AND WE ALSO ADDED SOME ARCHITECTURAL ARCHITECTURAL RESTRICTIONS TO UPGRADE WHAT WAS GONNA BE BUILT AT THE REQUEST OF COUNCILMAN HURST AS WELL.
SO, UM, I'M HAPPY TO ANSWER ANY QUESTIONS YOU HAVE.
WE HAVE ONE SPEAKER CARD THAT IS IN OPPOSITION AND THAT IS FOR SHANDA BROWN.
YOU HAVE THE FLOOR FOR THREE MINUTES.
MY NAME IS SHONDA BROWN AND I AM THE PRESIDENT OF THE HOA FOR COPPER OAKS COMMUNITY.
WE ARE ONE OF THOSE EXISTING PUDS THAT HE SPOKE ABOUT.
I CAME TO FIND OUT MORE INFORMATION, UH, IT LOOKS LIKE ALL AROUND US.
WE'RE GETTING MORE RESIDENTIAL PLACES, WHICH IT'S FINE, BUT WHEN WE START REDUCING THE ABILITY TO HAVE BUSINESSES THERE, THAT'S CONCERNING TO US.
WE HAVE VERY LIMITED PLA A A VERY LIMITED AMOUNT OF PLACES TO SPEND OUR MONEY IN OUR OWN COMMUNITIES.
WE LIVE HERE BUT WE SPEND OUR DOLLARS ELSEWHERE.
SO IF THERE ARE PLACES FOR, UM, COMMERCIAL BUSINESSES TO COME IN, WE DON'T WANT TO SEE THAT REDUCED, ESPECIALLY TO BRING IN MORE HOMES LIKE WE HAVE.
SO WE ARE A COMMUNITY OF 40 HOMES, PROBABLY THE FIRST OR THE SECOND HOOD.
AND THEN THE NEXT ONE HAD 20 ADDITIONAL HOMES ON THIS SIDE AND THEN THERE'S ONE FOR 210 HOMES ON THE SIDE OF THAT.
SO WE'RE GROWING AS FAR AS, UH, PLACES FOR PEOPLE TO LIVE, BUT WE WOULD LIKE TO SEE MORE OPPORTUNITY FOR COMMERCIAL BUSINESSES TO COME IN.
I WAS ABLE TO UNDERSTAND THAT HE'S REDUCING IT NOT COMPLETELY.
UM, SO HE'S JUST TRYING TO REDUCE IT DOWN A LITTLE BIT.
SO WE JUST WANNA KNOW MORE ABOUT WHAT TYPES OF HOMES THESE ARE.
ARE THEY GOING TO BE LOW INCOME HOMES OR WILL IT BE HOMES THAT ARE FOR SALE? WILL IT BE UM, RENTAL PLACES OR WILL PEOPLE BE PURCHASING THOSE HOMES? THANK YOU.
THAT WAS OUR ONLY SPEAKER COURSE.
I'LL INVITE THE APPLICANT BACK FOR A FIVE MINUTE REBUTTAL.
SO IT'S MY UNDERSTANDING THAT THE CURRENT APPLICANT IS THE OWNER OF ALL OF THE HOMES THAT SURROUND THIS PROPERTY AND THAT THEY'RE CURRENTLY RENTALS.
WE DON'T KNOW EXACTLY WHAT THESE WILL BE, THAT WE KNOW THAT THEY WILL BE TOWNHOMES.
THAT'S THE INTENT IS THAT THEY'RE GOING TO BE TOWNHOMES.
THERE'S A RESTRICTION ON THE P SO THAT IT WILL NOT BE MULTIFAMILY.
IN A PERFECT WORLD, WE WOULD BE ABLE TO DO COMMERCIAL, BUT AS MANY OF YOU KNOW, IT'S NOT THAT EASY TO GET COMMERCIAL WITHOUT THE ROOFTOPS.
SO THE MORE ROOFTOPS THAT COME, THE MORE LIKELY WE ARE THAT WE CAN GET COMMERCIAL.
IF, IF COMMERCIAL WAS POSSIBLE RIGHT NOW THE APPLICANT WOULD LOVE TO DO IT.
YOU GET MORE PRICE PER SQUARE FOOT FOR THE ACREAGE, BUT IT'S JUST NOT POSSIBLE RIGHT NOW 'CAUSE THERE'S NOT ENOUGH DEVELOPMENT IN THE AREA.
SO WE'RE HOPING THAT WITH THE ADDITIONAL TOWN HOMES WE'LL BE ABLE TO PUT SOME COMMERCIAL THERE AND, YOU KNOW, GET SOME ADDITIONAL PROPERTY IN THAT AREA.
ANYWAY, I'M HAPPY TO ANSWER YOUR OTHER QUESTIONS YOU HAVE.
COMMISSION MEMBERS AT THIS TIME I'LL CLOSE THE PUBLIC HEARING AND INVITE ANY QUESTIONS OR COMMENTS.
QUESTION, UH, I BELIEVE WE HAVE A QUESTION FROM COMMISSIONER ADDISON.
WOULD THAT BE FOR THE APPLICANT? NO, FOR THE, YEAH, FOR THE APPLICANT.
UM, I UNDERSTAND THAT YOU GUYS ONLY REDUCED 'EM BY FOUR ACRES, BUT, UM, I THINK THE YOUNG LADY HAS A GOOD POINT THAT WHEN WE PUT THESE FUDS TOGETHER, WE KIND OF HAD DONE SOME RESEARCH AS TO WHAT THE NEEDS ARE IN AREAS AND WE GENERALLY DON'T COME BACK IN THE MIDDLE OF THE PROCESS AND SAY WE'RE GONNA REDUCE THIS AMOUNT AND ADD MORE HOUSING.
THAT'S PART OF THEIR POINT IS THAT THERE'S A LOT OF HOUSING GOING ON IN THE AREA AND THE COMMERCIAL REDUCTION REALLY NOW FEEDS OFF THE HOUSING.
IF YOUR CLIENT WAS ONLY JUST DOING THE HOUSING COMPONENT, THEN THERE WOULD TECHNICALLY BE NO REASON TO REDUCE THE COMMERCIAL SIDE ONE WAY OR THE OTHER.
BUT THE ROOFTOPS THAT ARE COMING IN THAT AREA, IT SHOULD DESIRE SOME ADDITIONAL COMMERCIAL DEVELOPMENT BECAUSE THERE ARE A LOT OF HOUSES GONNA GOING UP IN THAT AREA.
AND, AND TO REDUCE THE COMMERCIAL SIDE BEFORE YOU'VE COMPLETED IT KIND OF SAYS YOU ABANDONING THE IDEA.
WHEN WE STARTED THE, THE, THE, THE, THE SPUD THAT COMMERCIAL PIECE, AND I, AND I GENERALLY DON'T UNDERSTAND WHEN YOU, WHEN YOU DO THAT AFTER YOU FINISH YOUR, YOUR, YOUR, YOUR, YOUR HOUSING COMPONENTS, THEN YOU'VE REASSESS WHAT YOUR NEEDS ARE.
[00:20:01]
YOU KNOW, 'CAUSE SOME THINGS ON PAPER WHEN YOU DO YOUR ASSESSMENTS INITIALLY THE, THE ECONOMY CHANGES AND A WHOLE LOT OF OTHER THINGS CHANGES AND IT'S KIND OF HARD TO GET THERE.BUT WE HAVE NOT EVEN FINISHED THE BUILD OUT YET IN THAT AREA.
THERE ARE A LOT OF HOUSES STILL GOING UP IN THAT AREA AND, AND, AND TO START REDUCING THE COMMERCIAL SIDE BEFORE THAT TAKES PLACE KIND OF LOOKS TO BE LOOK PREMATURE TO ME.
SO COUNCILMAN HURST AND, UH, MR. HOLCOMB AND I ALL MET AND TALKED ABOUT THIS IN GREAT DETAIL BECAUSE HE REALLY WANTS COMMERCIAL IN THAT AREA AS WELL.
AND SO WE LOOKED AT A LOT OF THE THINGS IN THAT AREA ABOUT THE TYPES OF COMMERCIAL THAT YOU CAN BRING TO AN AREA RIGHT NOW WITHOUT ENOUGH ROOFTOPS.
AND THE REALITY IS YOU CAN'T BRING ANY NATIONAL RETAILERS AND YOU REALLY CAN'T BRING WELL ON A NATIONAL BASIS OR REGIONAL BASIS.
THE COMMERCIAL USERS WILL NOT COME BECAUSE THERE'S NOT ENOUGH TRAFFIC COUNTS.
THEREFORE WE CAN ONLY GET REALLY THE LOCAL STUFF OR WE CAN ONLY GET THINGS THAT HE DID NOT WANT TO COME ON A COMMERCIAL BASIS.
FOR EXAMPLE, IF YOU LOOK DOWN THE STREET, THERE'S LIKE A PAINT BALL THAT'S COMMERCIAL THAT WAS A CONCRETE FACTORY THAT'S COMMERCIAL, BUT THAT'S NOT THE KIND OF THINGS THAT HE FORESEES IN HIS AREA.
THAT'S NOT THE KIND OF THING WE WANNA PUT NEXT TO HOMES.
AND SO WHAT WE TALKED ABOUT WAS TRYING TO KEEP SOME COMMERCIAL, WHICH WE WOULD LOVE TO DO COMMERCIAL IF WE CAN GET THE ROOFTOPS.
BUT WHAT WE DID IS WE TALKED ABOUT REDUCING THE RESIDENTIAL AND DOING TOWN HOMES, WHICH HE VERY MUCH SUPPORTS.
AND THEN KEEPING A COMMERCIAL COMPONENT SO THAT WE CAN DO IT HOPEFULLY ONCE WE HAVE THE ROOFTOP, IT'S NOT AN ABANDONMENT OF WHAT WE WANT IT TO DO.
IT'S THAT RIGHT NOW THERE'S NOT ENOUGH DEVELOPMENT IN THE AREA TO BRING THE QUALITY RETAILERS, THE COUNCILMAN HIRST ONCE IN THAT AREA.
SO WE'RE REALLY NOT GETTING AWAY FROM IT WHATSOEVER.
IT'S JUST THAT WE'RE, WE'RE MOVING WITH THE ECONOMY AND WHAT IT'S ALLOWING US TO DO.
I MEAN I I I UNDERSTAND THE CONCEPT AND I SAY IT AGAIN, THE REDUCTION IS VERY SMALL AND IT'S MOUTH FOUR ACRES OUT OF THE, OUT OF THE 19 ACRES, 4.1 ACRES OUT OF THE 19.
UH, BUT MY, MY MY MY MY STATEMENT WAS IF WE START ABANDONING ON THE FRONT SIDE, WE'LL BE BACK HERE ANOTHER YEAR OR TWO YEARS FROM NOW.
I MEAN, BECAUSE WE'VE NOT LET, LET THE DEVELOPMENT TAKE PLACE IN THE WHOLE AREA TO SEE THAT IMPACT.
I MEAN WE REALLY HAVE NOT, AND I UNDERSTAND THAT YOUR, YOUR CLIENTS, HIS HIS INITIATIVE TO MAKE SURE THAT HE HAS THE BEST BANG FOR HIS BUCK, WHETHER IT'S TOWNHOUSES OR WHATEVER THE YOUNG LADY WAS TRYING TO RAISE THE POINT.
THERE ARE A LOT OF HOUSES GOING ON IN THE AREA AND IF YOU DO, AT SOME POINT THE COMMERCIAL IS GONNA CATCH UP WITH THE HOUSING COMPONENT IF YOU DON'T WAIT TO SEE WHEN THAT CATCHES UP.
BUT WHEN YOU PUT THE SPUD TOGETHER, YOU PROJECTED WHAT WAS SUPPOSED TO TAKE PLACE.
WE, WE PROJECTED WHAT WOULD TAKE PLACE ON THE, ON THE PUD AND IN THE SURROUNDING AREA.
THAT HADN'T CAUGHT UP THAT QUICKLY.
AND IF WE HUSTLE RIGHT NOW TO TRY TO MEET THE PUD, THEN THE NEIGHBORS ARE GONNA BE COMING AND SAYING THAT'S NOT THE KIND OF COMMERCIAL WE WANT, NOR IS IT THE KIND OF COMMERCIAL WE WOULD WANT TO PUT NEXT TO RESIDENTIAL.
AND SO THAT'S WHY COUNCILMAN HURST THOUGHT IT WAS A GOOD IDEA TO DO MORE TOWN HOMES AND JUST KEEP THE COMMERCIAL SO THAT WE CAN TRY TO GET THERE.
IT'S A COMPROMISE ON EVERYBODY'S HAND TO TRY TO GET THERE.
AND IT IS, I MEAN I, I UNDERSTAND, AS I SAY, AGAIN, I UNDERSTAND THE CHALLENGE.
UM, BUT WHEN WE PUT THESE SPUDS TOGETHER, THAT WAS ONE OF THE REASONS WHY WE DESIGNED THE SP WHEN I WAS ON THE COUNCIL TO TRY TO MAKE SURE THE RESIDENTS KNEW WHAT WAS COMING.
AND WE DON'T, WE'VE HAD THAT BIG DEBATE ABOUT WHEN DO WE CHANGE AND WHEN THEY, WHEN THE ECONOMY DOES NOT WORK IN SCALE WITH THE DEVELOPMENT ITSELF, HOW DOES THAT CHANGE? BECAUSE IF WE ALLOW THESE CONCEPT PLANS TO BE PUT IN PLACE AND THEN WHENEVER IT'S NOT PRACTICALLY A FEASIBLE TO THE DEVELOPER, HE COME BACK HERE AND ASK FOR A CHANGE, BUT THEN WE DON'T GET WHAT WE DESIRED.
WHEN WE TOLD THE PEOPLE WHEN WE FIRST STARTED OUT, THAT'S WHAT WE WERE DOING.
I MEAN, SO AGAIN, THE FOUR ACRES IS NOT A BIGGER DEAL, BUT THE IDEA OF THE CONCEPT IS A BIG DEAL THAT, THAT YOUR, YOUR CLIENTS DID A DEVELOPMENT.
THEY, THEY HAD A PROJECTION OF WHAT IT WOULD TAKE.
THEY HAD AN IDEA OF WHAT IT WAS GONNA BE FOR BUILD OUT OR THEY WOULD'VE ALREADY GOTTEN WITH PRE-CONCEPT, UH, DEVELOPERS IN THE COMMERCIAL AND INDUSTRY.
BECAUSE IF EVERYTHING WAS GOING TO BUILD OUT AS YOU HAD THE DESIRE AND YOU HAD PRE UH, UM, PARCELED OUT THE COMMERCIAL SIDE, YOU WOULD KNOW WHAT WAS COMING THERE.
YOU'D HAVE AN IDEA OF WHAT WAS COMING THERE.
'CAUSE THESE ARE SIGNIFICANT INVESTMENTS OF WHAT THEY ARE.
THEY'RE NOT SMALL CHANGE INVESTMENTS TO ANYBODY.
SO SO THE FOUR ACRES IS NOT WHAT I'M, I'M TRYING TO ADDRESS BECAUSE THE FOUR ACRES IS MINIMALIST IN COMPARISON, BUT IF YOU DON'T COMMERCIAL, DON'T KEEP UP WITH WHAT YOU'RE DOING, YOU'LL BE ASKING FOR ANOTHER REDUCTION FROM THE FOUR ACRES TO ANOTHER FIVE ACRES.
THEN IT'S NINE OUT OF THE 19, OR YOU'RE ASKING FOR ANOTHER SEVEN OUT OF THE OUT AND NINE, IT'S 12 OUT OF THE 19 AND YOU'RE DOWN TO FOUR ACRES UP TO COMMERCIAL PROPERTY.
'CAUSE YOU SAID IT DIDN'T KEEP UP WITH WHAT YOU THOUGHT, WHAT YOUR PROJECTIONS WERE.
YOU'RE NOT DOING IT TODAY, BUT I'VE BEEN HERE LONG ENOUGH TO SEE THEM P**S IT OFF BY PIECE, BY PIECE BY PIECE AND NOT YOUR CLIENTS, NOT, NOT THIS DEVELOPMENT.
'CAUSE I'M GONNA MAKE A MOTION TO APPROVE IT AS IT IS.
BUT I WANT TO PUT THAT ON THE RECORD THAT WHEN WE COME WITH THESE CONCEPT PLANS, THAT'S THE REASON WHY WE
[00:25:01]
COME WITH THE CONCEPT PLANS BECAUSE WE LET PEOPLE COMFORTABLE THAT WHAT THEY'RE GETTING IN THIS FOOT, WHAT THEY'RE GETTING IN THESE, THESE CONCEPT PLANS IS WHAT THEY'RE GONNA SEE IN THE END OF THE ROAD.BUT
HE, HE NEEDED A LEVEL OF COMFORT.
UM, THIS IS A MAJOR CHANGE TO THAT PREVIOUSLY APPROVED CONCEPT PLAN.
THAT THAT'S WHY IT REQUIRES NOT ONLY THIS BODY TO RECOMMEND APPROVAL, BUT IT ALSO REQUIRES COUNSEL TO MAKE THAT, THAT MAJOR CHANGE.
AND THANK YOU ERIC FOR YOUR, FOR YOUR, YOUR TIME.
MR. CHAIRMAN, I'D LIKE TO MAKE A MOTION FOR APPROVAL, PLEASE.
THERE IS A MOTION ON THE FLOOR FROM COMMISSIONER ADDISON TO APPROVE THIS ITEM.
IS THERE A SECOND? SECOND FROM COMMISSIONER FOWLER? ARE THERE ANY OBJECTIONS, ANY ADDITIONAL DISCUSSION? SEEING NONE, THIS ITEM IS APPROVED AT THIS TIME.
WE'LL MOVE ON TO ITEM NUMBER 17 C.
FIRST CS, I'M SORRY, SIX ITEM NUMBER 16.
[16. CS-6-24 Lake Jolie Vue Subdivision (Deferred from July 15 by the Planning Director)]
CS 6 24 LAKE JOLIE VIEW SUBDIVISION CS 6 24 LAKE JOLLY VIEW.SUBDIVISION PROPERTY IS LOCATED ON THE NORTH SIDE OF TALMAG DRIVE WEST OF RENEE COURT COUNCIL DISTRICT ONE NOEL.
THE APPLICANT IS PROPOSING A FLAG LOT MINOR SUBDIVISION WITH TWO LOTS.
FUTURE VR LAND USE DESIGNATION IS RESIDENTIAL NEIGHBORHOOD CS 6 24 LAKE JOLLY VIEW.
SUBDIVISION PLANNING COMMISSION.
STAFF CERTIFIES THAT THE PROPOSED REQUEST MEETS A MINIMUM REQUIREMENTS OF THE UNIFIED DEVELOPMENT CODE FOR PLANNING COMMISSION CONSIDERATION COMMISSION.
AT THIS TIME, I OPEN THE PUBLIC HEARING AND INVITE THE APPLICANT TO SPEAK FOR A PERIOD NOT TO EXCEED 15 MINUTES.
I'LL ALSO ADVISE THE APPLICANT THAT THERE ARE NO ADDITIONAL SPEAKER CARDS FOR THIS ITEM.
GOOD EVENING, STEVEN LACORE, UH, L AND L LAND SERVING.
UH, SIMPLY US DIVIDING THE PROPERTY WHERE IT'S ALREADY NATURALLY BEING DIVIDED BY THE POND.
UM, AND THAT'S WHAT THE CLIENTS ARE TRYING TO DO.
AT THIS TIME I'LL CLOSE THE PUBLIC HEARING AND INVITE ANY QUESTIONS, COMMENTS, OR MOTIONS FROM THE COMMISSION.
I BELIEVE THERE'S A MOTION, UH, OR QUESTION FROM VICE CHAIRMAN GAR.
THERE'S A MOTION TO APPROVE FROM VICE CHAIRMAN GARDER.
I BELIEVE THERE'S A SECOND FROM COMMISSIONER ADDISON.
ARE THERE ANY OBJECTIONS? ANY FURTHER DISCUSSION? SEEING NONE, THAT ITEM IS APPROVED.
DIRECTOR HOLCOMB, IS IT OKAY FOR US TO MOVE ON? ITEM NUMBER 17 AT THIS TIME? ABSOLUTELY.
ALRIGHT, WE'LL MOVE ON TO ITEM NUMBER
[17. CONSENT FOR APPROVAL CS-8-24 Anna Lusk Jones Tract]
17.ANNA LUSCA JONES TRACT PROPERTY IS LOCATED ON THE EAST SIDE OF JAW ROAD, NORTH OF L SCOTT AVENUE COUNCIL DISTRICT FIVE HURST.
THE APPLICANT IS F DEWITT LADNER.
THE APPLICANT IS PROPOSING A FLAG LOT MINOR SUBDIVISION WITH TWO LOTS.
FUTURE VR LAND USE DESIGNATION IS RESIDENTIAL NEIGHBORHOOD CCFS 8 24.
ANNA LUSK JONES RET PLANNING COMMISSION STAFF CERTIFIES THAT THE PROPOSED SUBDIVISION REQUEST MEETS SOME MINIMUM REQUIREMENTS OF THE UNIFIED DEVELOPMENT CODE FOR PLANNING COMMISSION CONSIDERATION COMMISSION MEMBERS.
AT THIS TIME, I'LL OPEN THE PUBLIC HEARING AND INVITE THE APPLICANT TO SPEAK FOR A PERIOD NOT TO EXCEED 15 MINUTES.
STEVEN LORGAN, LL LANCER GANG.
UM, THE PROPERTY OWNER'S, UH, SIMPLY, UH, CUTTING A LOT AROUND A HOUSE SO HE CAN PUT IT UP FOR SALE.
UH, THE FLAG LOCK OPTION IS HE'S LEAVING 40 FOOT FOR ACCESS TO ALL OF THE ACREAGE BEHIND.
WE HAVE TWO SPEAKER CORDS THAT ARE IN OPPOSITION.
THE FIRST IS FOR JONATHAN AND LAUREN CASIO.
HI, YOU HAVE THE FLOOR FOR THREE MINUTES.
UM, I'M LAUREN CASIO AND MY FAMILY HAS BEEN, UM, ON ATTRACTIVE LAND, LIKE NOT EVEN A QUARTER MILE, UM, UP JEWEL FROM THIS PARTICULAR LOCATION FOR 30 YEARS.
AND, UM, WE'VE GOT OUR GOOD NEIGHBOR, MR. MIKE WILLIAMS, WHO IS ALSO HERE WITH US, UM, WHO HAS BEEN ON HIS LAND FOR 21 YEARS.
SO WE'RE IN THE HANDFUL OF ADDRESSES THAT ARE, UH, NORTH OF THE, UH, LIGHT AT MICKENS ROAD.
SO, UM, WHAT OUR CONCERN IS HERE, AND I I WOULD ALSO LIKE SOME CLARIFICATION ON, UM,
[00:30:02]
HOW MUCH LAND WE'RE TALKING ABOUT BECAUSE WHENEVER I WAS LOOKING AT THE DOCUMENTS, UH, ONLINE, I THOUGHT THAT THIS WAS SOMETHING LIKE 43 ACRES.UM, MR. MIKE WAS THINKING THAT WE'RE TALKING ABOUT ONE ACRE.
SO I WOULD LIKE CLARIFICATION ON THAT.
HOWEVER, UM, I WE JUST WANTED TO MENTION THAT ALL OF THE ADDRESSES, UM, NORTH OF JOER IN BETWEEN, UH, MICKENS ROAD AND THE EE RIVER BRIDGE, WE ARE NOT ON A MAIN WATER LINE OUT OF BATON ROUGE.
WE ARE ON, UM, A VERY SMALL LINE, PROBABLY ABOUT THAT BIG, UM, THAT, UH, TIES OFF FROM THE MAIN WATER LINE AT WHAT USED TO USED TO BE MR. SAN'S PROPERTY.
UM, THE HOUSE IS NO LONGER THERE.
IT'S RIGHT NEXT TO THE LIGHT AT KINS ROAD.
UM, THE CURRENT WATER LINE THAT IS THERE, UM, FREQUENTLY LEAKS.
UH, WE HAVE ISSUES WITH WATER PRESSURE.
UM, WE'VE HAD OUR WATER, UH, COME OUT DOWN TO A TRICKLE.
UM, THIS HAS BEEN AN ONGOING PROBLEM FOR MANY YEARS.
AND THE CONCERN HERE IS THAT IF WE'RE PUTTING A, UM, LIKE A NEIGHBORHOOD IN, UM, YOU KNOW, ON THE OTHER END OF THAT, THEN THAT'S GONNA FURTHER IMPACT, UM, OUR WATER PRESSURE AND WATER AVAILABILITY.
THE OTHER THING THAT I WAS LOOKING AT IS THAT, UM, FROM WHAT I UNDERSTAND, 75% OF THIS, UM, ACREAGE, UH, IN QUESTION IS, UM, IN A FLOOD ZONE AND IT'S RIGHT NEXT TO THE COME MEET.
UM, SO THE RECOMMENDATION I THINK WAS THAT SOME OF THAT BE BUILT UP IF THERE WERE TO BE HOUSES PUT THERE.
AND, UM, WE ARE CONCERNED HOW THAT WOULD IMPACT OUR PROPERTY BECAUSE WE'RE, SO THERE'S THIS, UM, TRACK IN QUESTION AND THEN, UM, THERE IS, UM, ONE TRACK, TWO TRACK AND THEN ME AND MY HUSBAND AND THEN, UH, MR. MIKE.
SO WE'RE, WE'RE VERY CLOSE TO, UM, THIS AREA IN QUESTION.
SO OUR CONCERN IS THAT IF THAT LAND IS BUILT UP, COULD THAT CAUSE UM, SOME FLOODING ISSUES FOR OUR PROPERTIES, UM, THAT IS NEXT TO IT.
UM, I THINK THAT SOME OF THESE, UM, ADDRESSES THAT ARE ON THAT END.
SO THERE'S LIKE, UM, A LARGE HOUSE RIGHT BEFORE THE UTE BRIDGE AND REBEL ELECTRIC COMPANY, YOU HAVE ABOUT 10 SECONDS, RIGHT? OKAY.
THEY'RE ALL ON JUST ONE METER.
SO WHAT ARE THEY GONNA DO ABOUT THE, UM, THE SEPTIC TANKS AND, AND THE WATER IS WHAT OUR CONCERN IS? THANK YOU.
WE HAVE ONE OTHER SPEAKER CARD FOR MR. MICHAEL WILLIAMS, BUT HE'S INDICATED THAT HE DOES NOT WISH TO SPEAK.
SO AT THIS TIME I'LL INVITE THE APPLICANT BACK FOR A FIVE MINUTE REBUTTAL.
I PROBABLY SHOULD HAVE SAID A LITTLE MORE.
I UNDERSTAND THE CONCERNS SHE'S TALKING ABOUT.
UM, THIS DIVISION PROPERTY IS SIMPLY TO, UH, CREATE THE TRACK AROUND AN EXISTING HOUSE UP THERE IN THE FRONT.
AND, UH, THE OWNER DOES NOT PLAN TO DEVELOP ANY OF THE LARGE TRACK IN THE REAR.
UH, HE ALSO OWNS THE OTHER LARGE TRACK BEHIND THAT PROPERTY AS WELL.
UH, IT'S, IT'S JUST TO CREATE THE TRACK AROUND THAT EXISTING HOUSE TO, UH, SELL TO THE TENANTS.
AT THIS TIME I'LL CLOSE THE PUBLIC HEARING AND INVITE, UH, QUESTIONS OR COMMENTS.
I BELIEVE WE HAVE A QUESTION OR COMMENT FROM, UH, VICE CHAIRMAN GROUT.
NO, THE, UH, THE APPLICANT ANSWERED THE QUESTION THAT THERE IS NO DEVELOPMENT, THIS IS AN EXISTING, THIS IS EXISTING, THERE'S NOT GONNA BE ANY CHANGES IN FAR AS AS ADDING ADDITIONAL STRUCTURES, ET CETERA.
SO, UH, THAT WAS, THAT WAS MY ONLY QUESTION.
AND I, I MAKE A MOTION WE APPROVE.
THERE'S A MOTION ON THE FLOOR FROM VICE CHAIRMAN GROUT TO APPROVE THIS ITEM.
IS THERE A SECOND TO THAT MOTION? SECOND WOULD COMMENT.
WELL, IS THERE A SECOND TO THE SECOND MOTION TO APPROVE? SECOND.
THE MOTION HAS BEEN APPROVED BY COMMISSIONER ADDISON, WHO ALSO HAS A COMMENT THAT HE'D LIKE TO MAKE.
IT WAS JUST TO GIVE ACCESS TO THE PROPERTY AND THAT'S WHY WE WANT TO BE CLEAR THAT THERE'S NO DEVELOPMENT GOING ON AND THAT'S WHY THE ENGINEERING JUST CAME BACK UP TO EXPLAIN THAT.
WE JUST WANT YOU TO KIND OF UNDERSTAND THAT THERE'S NO DEVELOPMENT.
AND I'LL ALSO ADD IF AND WHEN AN ADDITIONAL HOUSE OR STRUCTURE WOULD, WOULD BE BUILT, UH, THERE'S, THERE'S VERY SPECIFIC PROCESSES THEY WOULD HAVE TO GO THROUGH, UH, SPECIFICALLY REGARDING FIELD MITIGATION.
ANY NEW DIRT BROUGHT IN WOULD HAVE TO BE MITIGATED AND PERMITTING.
UH, AGAIN, THERE'S A, A VERY STRICT PROCESS TO THAT.
SO THERE ARE A LOT OF CHECKS AND BALANCES.
THERE'S A MOTION AND A SECOND, UH, TO APPROVE THIS ITEM.
[00:35:02]
ANY FURTHER DISCUSSION? SEEING NONE, THAT ITEM IS APPROVED AND WE WILL MOVE ON[22. S-4-24 Parkway Lakes Subdivision ]
TO ITEM NUMBER 22.SUBDIVISION 4 24 PARKWAY LAKE SUBDIVISION S 4 24 PARKWAY LAKES SUBDIVISION PROPERTY IS LOCATED ON THE SOUTH SIDE OF PARKWAY DRIVE, SOUTH OF RAMONA AVENUE COUNCIL.
THE APPLICANT IS MICKEY ROBERTSON.
THE APPLICANT IS PROPOSING A MAJOR RESIDENTIAL SUBDIVISION WITH 151 LOTS IN PUBLIC STREET ACCESS.
FUTURE BUREAU LAND USE DESIGNATION IS RESIDENTIAL NEIGHBORHOOD S 4 24 PARKWAY LAKES SUBDIVISION PLANNING COMMISSION STAFF CERTIFIES THAT THE PROPOSED SUBDIVISION REQUEST MEETS THE MINIMUM REQUIREMENTS OF THE UNIFIED DEVELOPMENT CODE.
FOR PLANNING COMMISSION CONSIDERATION, WE'VE RECEIVED ONE MESSAGE IN OPPOSITION FROM THE ADJACENT SAGE FIELD SUBDIVISION, HOA PRESIDENT.
AT THIS TIME, I'LL INVITE THE APPLICANT TO SPEAK FOR A PERIOD NOT TO EXCEED 15 MINUTES, AND I WILL LET YOU KNOW THAT THERE IS A SPEAKER CARD IN OPPOSITION FOR THIS ITEM.
UH, MICKEY ROBERTSON, MR. ENGINEERING, UM, HERE TONIGHT TO PRESENT THE PULMONARY PLAID FOR PARKWAY LAKES.
AS YOU HEARD, IT'S 151 LOTS ON 36 ACRES.
UH, IT'S LOCATED ON THE SOUTH SIDE OF BURBANK, WEST OF BLUEBONNET.
UH, THERE'S AN EXISTING PARKWAY DRIVE THAT COMES OFF OF BURBANK AND GOES INTO THE PROPERTY.
THERE PREVIOUSLY WERE SEVEN LARGE LOTS APPROVED ON THIS SITE.
UH, THE PROPERTY IS, UH, CURRENTLY ZONED RURAL WITH AN RN DESIGNATION, WHICH ALLOWS FOR 50 BY ONE 20 LOTS, UH, AT A DENSITY OF 4.1 LOTS PER ACRE, WHICH IS WHAT WE'RE PROPOSING.
UH, THIS DEVELOPMENT IS WHAT'S COMMONLY REFERRED TO AS A USE BY RATE.
UH, WE HAVE MET ALL OF THE REQUIREMENTS OF THE UDC IN TERMS OF THE PLANNING COMMISSION STAFF, UH, ZONING REQUIREMENTS, SETBACKS.
WE HAVE ALSO, UH, DONE AN EXTENSIVE DRAINAGE STUDY.
YOU KNOW, I'M SURE YOU'RE AWARE OF THE NEW PROCESS IN EAST BAT IES PARISH WHERE YOU HAVE TO GO THROUGH AN OFFSITE DRAINAGE ANALYSIS AND A CONVEYANCE CHECK.
WE HAVE PASSED ALL OF THOSE REQUIREMENTS.
UH, WE ARE MAKING IMPROVEMENTS TO THE DRAINAGE IN THE AREA.
UH, IN EVERY CASE FOR EVERY DESIGN STORM WE ARE, UH, MAKING AN IMPROVEMENT OR AT LEAST NOT HAVING A NET IMPACT.
UH, SPECIFICALLY AS IT RELATES TO THE, UH, SOUTHERN PROPERTY LINE OF THE SITE, WHICH IS ADJACENT TO THE SAGE FIELD, UH, SUBDIVISION.
UH, WE UNDERSTAND THEY HAD SOME DRAINAGE ISSUES IN 2021 WITH MAYBE A, A RAIN BOMB OR SOMETHING.
UH, WE ALSO, UH, WE HELD AN A COMMUNITY OUTREACH MEET OUTREACH MEETING ON SEPTEMBER 5TH WITH THE SPRING LAKE AND BLUE BOND HIGHLANDS, HOA AT THEIR CLUBHOUSE THERE ON BLUEBONNET.
UH, WE HAD ABOUT 30 PEOPLE THAT ATTENDED VERY PRODUCTIVE MEETING.
UH, AT THE END OF THE MEETING.
WE FELT LIKE THEY UNDERSTOOD WHAT WE'RE DOING AND, YOU KNOW, THEY WERE APPRECIATIVE OF OUR EFFORTS, UH, AND THAT WE'D BE VERY COMPARABLE WITH THEIR NEIGHBORHOOD.
UM, UNFORTUNATELY WE INVITED, UH, SAGE FIELD TO THAT MEETING, BUT THEY COULD NOT ATTEND.
UH, AND THEN WE TRIED TO HAVE A MEETING LAST WEEK, UH, WITH SAGE FIELD.
AS YOU KNOW, WE HAD A LITTLE HURRICANE FRANCINE THAT KIND OF MESSED UP A LOT OF PLANS LAST WEEK.
UH, BUT OBVIOUSLY THE INVITATION IS STILL OPEN.
UH, WE'RE ALWAYS TRANSPARENT WITH WHAT WE'RE DOING AND BE HAPPY TO HAVE A DISCUSSION WITH 'EM AT ANY TIME TO FURTHER ANSWER ANY QUESTIONS THAT THEY MAY NOT GET ANSWERED TONIGHT.
UM, AS I SAID BEFORE, YOU KNOW, IT'S A USE OF MY RIGHT.
WE PREPARE PREPARED A PLA THAT MEETS ALL THE REQUIREMENTS WE'RE HELPING OUT IN THE DRAINING SITUATION.
UH, WE WE'RE NOT ASKING FOR ANY REZONING, WAIVERS OR VARIANCES STRICTLY BY THE BOOK.
AND SO IF YOU HAVE ANY FURTHER QUESTIONS, I'LL BE HAPPY TO ANSWER 'EM.
WE HAVE ANOTHER SPEAKER COURT THAT IS IN FAVOR BUT DOES NOT WISH TO SPEAK.
AND WE HAVE ONE THAT IS IN OPPOSITION AND DOES WISH TO SPEAK.
YOU HAVE THE FLOOR FOR THREE MINUTES, SIR.
LARRY GALLOWAY, UH, SAGEVILLE, HOA PRESIDENT.
UM, IF YOU REMEMBER BACK IN 2021, UM, THAT COMPLETE AREA FLOODED AND THE SAGEVILLE, UH, SUBDIVISION HAD ABOUT 40 TO 50 HOUSES THAT FLOODED.
UH, BUT ALSO IN FLOODING, UH, THE RIDGE PECAN, UH, STORE, UH, TOWNHOUSES, THE OUTER SELF STORAGE FLOODED AND EVERYTHING ALONG RAMONA, EXCUSE ME, RAMONA AND PARKWAY.
SO THIS IS A SERIOUS FLOOD ZONE.
AND BACK THEN WE WERE ABLE TO SPEAK WITH, UH, THE PEOPLE AT THEIR HARVESTING, UH, DEVELOPMENT, WHICH IS GOING ON DIRECTLY
[00:40:01]
ON THE EAST SIDE, WHICH IS FROM, UH, BLUE BONNET OVER TOS FIELD SUBDIVISION.AND THEY HAD A DITCH THAT WAS, UH, PLUGGED.
AND SO WE SPOKE WITH THEM AND I HAVE SOME PHOTOS IF YOU WANT TO LOOK AT 'EM, WHERE WE WORKED WITH THEM TO HAVE THOSE DITCHES CLEANED OUT AND CLEARED.
AND NOW WE'RE NOT HAVING ANY WATER CONCERNS COMING FROM THE HARVESTING AREA.
SO WE'RE ASKING, UH, THE PARKWAY LAKES DEVELOPERS TO ALSO GO IN.
THERE ARE DITCHES THAT COME FROM BLUE BAYOU FROM, UH, BAYOU FOUNTAIN THAT RUN, UH, EAST AND WEST BEHIND SAGEVILLE SUBDIVISION, WHICH IS THE OLD HERMITAGE SUBDIVISION.
THEY GOT ANOTHER DITCH THAT RUNS NORTH AND SOUTH BEHIND THE GOODWILL STORE THAT'S THERE.
AND THERE'S ANOTHER DITCH IN FRONT THAT'S ON RAMONA AND PARKWAY DRIVE, WHICH AFFECTS THE RESIDENCE AND THE PEOPLE THAT LIVE IN THAT PECAN RIDGE AREA.
SO IF WE WERE TO PUT THAT IN, UH, WE ARE THINKING THAT SAGEVILLE WOULD BE FLOODED AGAIN.
SO WE LOOKED AT THE PROPOSAL AND WHAT THEY HAVE IS A, WHAT DO YOU CALL IT? DETENTION POND THAT'S GOING TO RUN FROM ONE END OF THE OLD HERMITAGE, UM, STREET ALL THE WAY TO ELVIN DRIVE.
AND THAT RETENTION POND IS GONNA BE CUT.
SO THAT WATER FROM THAT, UH, CANAL OR DITCH THAT'S RUNNING THERE CAN OVERFLOW INTO THAT RETENTION POND OR DETENTION POND.
WE, WE JUST NOT, WE DON'T LIKE THAT.
SO WHAT WE ARE WANTING TO DO IS IF WE CAN GET CITY, PARISH AND THE DEVELOPERS OF THE PARKWAY LAKES, UH, SUBDIVISION TO CLEAR OUT THOSE THREE CANALS OR DITCHES.
THE DITCH IS ONE ON THE EAST SIDE.
NUMBER TWO IS ON THE SAGEVILLE SIDE OR THE SOUTH SIDE.
AND NUMBER THREE IS AT THE BEGINNING BEHIND, UH, THE TIME IS THE OUTER STORAGE FACILITY.
AT THIS TIME, I'LL INVITE THE APPLICANT BACK FOR A FIVE MINUTE REBUTTAL.
UH, WE WILL BE HAPPY TO, TO TALK TO YOU LATER AS WELL TOO.
UH, SO WHAT, WHAT I DID FAIL TO MENTION IN THE, THE INITIAL PRESENTATION IS THAT I HAVE BEEN WORKING WITH COUNCILMAN GOEY.
UH, HE WAS AT THE, UH, HOA MEETING THAT WE HAD ON SEPTEMBER 5TH.
UH, HE HAS PUT IN A 3 1 1 SERVICE REQUEST TO HAVE THIS WORK DONE.
UH, I ALSO PUT ONE IN TODAY TO HAVE, UH, SOME SIMILAR WORK DONE, UH, MAINLY WITH THE COVERT UNDERNEATH, UH, BURBANK THAT DRAINS ALL THE DITCHES THAT HE'S TALKING ABOUT.
UH, SO WE ARE PROACTIVELY, UH, HELPING WITH WHAT THEY'RE DOING AS WELL AS WITH THE WORK THAT WE'RE DOING THAT BENEFITS THE, IN THE AREA.
SO WE ARE ADDRESSING HIS CONCERNS.
BUT IF YOU HAVE ANY QUESTIONS, WE'LL BE HAPPY TO ANSWER 'EM.
AT THIS TIME I'LL CLOSE THE PUBLIC HEARING.
UH, MR. GALLOWAY DID THAT, DID THAT ADDRESS, UH, AT LEAST SOME OF YOUR CONCERNS? NO.
I'LL OPEN IT TO OTHER, UH, COMMISSIONERS.
UH, I'LL OPEN THE FLOOR TO OTHER COMMISSIONERS WITH ANY QUESTIONS THAT THEY MAY HAVE AND THEY MAY CHOOSE TO, UH, ASK YOU A QUESTION.
I HAVE ONE IN PARTICULAR THAT I'M PRETTY SURE IT'S GONNA DO JUST THAT.
I'M TRYING TO LOOK IN THE OPPOSITE OF THIS DIRECTION.
COMMISSIONER ADDISON, I'M JUST GONNA GO AHEAD AND CALL ON YOU.
CAN YOU COME BACK FOR SEC FOR A SECOND? I WILL.
UH, I'D LIKE TO EXPLAIN THAT THE DEVELOPERS HAD A MEETING.
IF YOU KNOW THE AREA, IT IT IS ON THE OTHER SIDE OF BLUE BONNET AT THE FAIRWAY VIEW OR FAIR.
WHAT IS IT? FAIR FAIR HILL WHAT? FAIR HILL AND THE SPRING LAKE AREA.
AND THEY'RE NOT GONNA BE AFFECTED BECAUSE DIRECTLY BEHIND SPRING LAKE IS A RETENTION POND AND THERE'S A LEVY BEHIND THAT.
THEY DON'T HAVE THE FEAR THAT WE HAVE BECAUSE WE FLOODED ALREADY.
SO I'M JUST ASKING TO DELAY UNTIL WE CAN GET THOSE DITCHES TAKEN CARE OF, OR IF THAT'S GONNA BE AT THE SAME TIME, CITY PARISH AND THE DEVELOPERS SHOULD WORK TOGETHER TO TRY TO SATISFY THE FACT THAT THOSE 40 OR 50 RESIDENTS THAT ARE LIVING DIRECTLY ON OLD HERMITAGE PARKWAY AND THOSE THAT ARE LIVING ON ST.
CROIX BACK IN THAT SOUTHWEST CORNER NEEDS A LOT OF WORK.
BUT THE DITCH THAT RUNS FROM BURBANK
[00:45:01]
DOWN THAT AREA, THEY TRIED TO CLEAR IT OUT, BUT THEY HAVEN'T COMPLETED IT.AND FROM ELVIN DRIVE THAT IT HASN'T BEEN COMPLETED.
WELL, WELL, AGAIN, I I, I DO UNDERSTAND YOUR CONCERN.
UM, I DON'T KNOW IF THAT'S PARTICULARLY A PLANNING COMMISSION CONCERN.
THE REALITY IS, IS THAT AS THE GENTLEMAN HAS STATED THAT THE, THE COUNCILMAN HAS PUT IN A SERVICE REQUEST ORDER AND TO CLEAN THE DITCHES OUT.
IT IS A WHOLE NOTHER MATTER AS OPPOSED TO A PLANNING COMMISSION, UH, ZONING MATTER.
UM, AND OF COURSE, IN ALL DUE RESPECTS, I DID WANT YOU TO COME BACK UP AND, AND EXPRESS YOUR CONCERNS.
BUT FOR US TO NOT TO APPROVE A DEVELOPMENT BASED UPON A CLEAN OUT OF A DITCH, NOT WHETHER WE ARE ENGINEERING THE DESIGNING THE DITCH, THAT'LL BE DIFFERENT IF WE WERE DESIGNING SOMETHING IN THIS PLAN AND ASSIGN AND APPROVING THE PLAN BASED UPON A LACK OF THE UP CAPACITY IN THE AREA.
UH, SO AGAIN, I DID WANT YOU TO GET YOUR EXPRESSIONS WHEN THE CHAIRMAN ASKED YOU DID THAT SATISFY YOUR CONCERN, THE CLEAN OUT OF THE DITCHES, YOU SHOULD PROBABLY GET WITH YOUR COUNCIL MEMBER AND LET THEM GET WITH PUBLIC WORKS.
AND IF YOU RESIDENT AND WE SPOKE WITH HIM.
WELL, AGAIN, I'M, I'M JUST EXPRESSING THAT'S NOT A PLANNING COMMISSION ISSUE FOR ME TO DECIDE HERE, THIS BODY TONIGHT.
I MEAN, 'CAUSE THERE ARE A LOT OF DISHES IN THIS PARISH THAT PROBABLY NEED CLEANING OUT, AND THERE'LL BE A LOT OF PEOPLE WHO HAVE THOSE CONCERNS.
UM, THIS DEVELOPER, WHETHER HE'S BUILDING RETENTION PONDS, HE HAS ENGINEERING REPORTS REGARDING THE DRAINAGE AND THEY'RE SATISFYING THEIR PARTICULAR IMPACT IN THE NEIGHBORHOOD IS WHAT WE SHOULD BE CONCERNED ABOUT.
NOW, AGAIN, I CONCUR THAT YOU MIGHT NEED YOUR DITCHES CLEANED OUT.
I WOULD CON I WOULD ENCOURAGE YOU TO WORK WITH YOUR COUNCILMAN TO MAKE SURE THAT HE CONTINUES TO WORK WITH PUBLIC WORKS TO GET THOSE THREE DITCHES THAT YOU, YOU HAVE EXPRESSED TO BE CLEANED OUT.
I MEAN, SO AGAIN, I I THINK YOU'VE ADDRESSED MY CONCERN.
I THINK YOU'VE ADDRESSED THE CHAIRMAN'S CONCERN AND THAT, THAT WE AT LEAST GAVE AN OPPORTUNITY TO EXPRESS THAT.
BUT AGAIN, I JUST, I I FEEL CONFIDENT THAT, YOU KNOW, THIS IS NOT A ZONING ISSUE TO WHICH WE ARE ADDRESSING TONIGHT.
SO THAT, THAT'LL BE MY, MY, MY TAKE ON IT.
THANK YOU COMMISSIONER ADDISON.

IS THERE A MOTION? THERE'S A MOTION FROM COMMISSIONER ADDISON TO APPROVE THIS ITEM.

WE STILL HAVE SOME PEOPLE IN THE AUDIENCE AND I DON'T KNOW IF THEY WERE HERE 'CAUSE THEY EITHER WERE OVERLOOKED OR DIDN'T UNDERSTAND WHAT WE WERE DOING.
I DON'T KNOW, UM, IF I CAN BE SO KIND.
JUST TRYING TO FIGURE OUT WHAT WE HAVE PEOPLE THAT ARE STILL WAITING ON TO HEAR.
I HAD ONE GENTLEMAN WHO TALKED ABOUT ITEM THREE, ANOTHER LADY TALKING ABOUT ITEM MA'AM.
I THINK WE'VE APPROVED THOSE ITEMS, BUT I JUST WANTED TO KIND OF HEAR WHEN PEOPLE SIT HERE THROUGH THESE MEETINGS, THROUGH THE WHOLE PUBLIC, THEY DON'T, MIGHT NOT UNDERSTAND WHAT WE'VE DONE.
IT APPEARS THAT ITEM 18 WAS ONE OF THE ONES ON THE CONSENT AGENDA.
