BONNIE BOULEVARD IS HOME TO THE RESOURCE BANK YOU FEEL GIVEN THE SUBJECT PROPERTY IS JEFFERSON HIGHWAY FRONTAGE.

YOUR PROXIMITY TO THE INTERSECTION OF JEFFERSON HIGHWAY AND BLUE BONNET AT THE SUBJECT PROPERTY SHOULD ALLOW FOR A HIGHER DENSITY USE.

WE ORIGINALLY SUBMITTED THE REZONING REQUEST TO REZONE THE PROPERTY FROM A ONE TO DOL.

THIS WAS DUE TO THE FACT WE HAD AN ATTORNEY GROUP LOOKING TO PURCHASE THE PROPERTY AND BUILD AN APPROXIMATE 7,000 SQUARE FOOT SINGLE STORY OFFICE BUILDING.

THE ZONING CLASSIFICATION WAS TOO BROAD IN THE EVENT THE PURCHASE FELL THROUGH AND WOULD POTENTIALLY ALLOW A MULTISTORY BUILDING ON THE SITE IN THE FUTURE.

THIS WAS NOT OUR INTENTION.

THE OWNER UNDERSTOOD THE NEIGHBORS CONCERN AND DECIDED TO SCALE OUR REZONING REQUEST BACK TO NC.

HOWEVER, NC ALSO ALLOWS USES THAT THE NEIGHBORHOOD OBJECTED TO IN BEING GOOD NEIGHBORS.

WE DECIDED TO SCALE OUR REQUESTS BACK TO THE NEIGHBORHOOD OFFICE.

AFTER SPEAKING TO MATT WATSON, WE BELIEVE THAT A NEIGHBORHOOD OFFICE ZONING CLASSIFICATION CAPTURES THE CORRECT AMOUNT OF COMMERCIAL DEVELOPMENT NEEDED FOR THIS SITE.

IT'S LOCATED IN AN UNDEVELOPED AREA AND CURRENTLY ZONE RULE IS ALSO DESIGNATED AS AGRICULTURAL RULE ON THE FUTURE OF FUTURE BR LAND USE DESIGNATION.

THE OWNER.

APPLICANT IS MIKE AND TERESA COP PREVIOUSLY OWNED PROPERTY LOCATED AT ONE ZERO SEVEN SIX HARNEY ROAD SINCE 1990 THAT PROPERTY WAS USED AS A LAW OFFICE FOR THERESA AND HER LAW PARTNER FRED CASTERS SINCE 2011 THAT PROPERTY WAS RECENTLY EXPROPRIATED FOR THE MEET RIVER DIVERSION PROJECT AND THE COPS PURCHASED THIS NEW PROPERTY AND WOULD LIKE TO CONSTRUCT AND OPERATE THE LAW OFFICE.

THERE BELOW IS A SUMMARY OF THE FACTS SURROUNDING THE APPLICATION.

NUMBER ONE THE APPLICANT IS REQUESTING REZONING OF THE PROPERTY FROM RURAL TO GENERAL OFFICE LOW RISE AND CHANGING THE FUTURE BR LAND USE DESIGNATION FROM AGRICULTURAL RULE TO OFFICE NUMBER TWO.

THE APPLICANT'S PROPERTY IS COMPLETELY SURROUNDED BY 107 ACRES AND WE HAVE A WRITTEN SUPPORT LETTER FROM THAT LAND OWNER WHO WOULD BE MOST DIRECTLY IMPACTED THE PROPERTY LOCATED APPROXIMATELY 350 YARDS NORTH OF THE PROPERTY AS A HOME LOCATED ON IT AND THAT LAND OWNER WHO OWNS OVER 100 ACRES HAS PROVIDED WRITTEN SUPPORT AS WELL AND 130 ACRES OF PROPERTY LOCATED TO THE SOUTH OF THE PROPERTY IS USED FOR A GRAVEL PIT MINING OPERATION.

THERE ARE NO HOMES LOCATED ACROSS THE STREET IN THE VICINITY OF THE PROPERTY AND THE ONLY HOMES ARE LOCATED APPROXIMATELY ONE HALF MILE AWAY NEAR TEDDY JUKES JOINT, WHICH IS A BAR AND VENUE FOR LIVE MUSIC.

ALTHOUGH RULES ZONING IS GENERALLY DESIGNATED IN THE AREAS NEAR THE PROPERTY.

THERE IS PUD ZONING FOR A LARGE DEVELOPMENT AND MINING OPERATIONS SOUTH OF THE PROPERTY, A BAR LOCATED NORTH OF THE PROPERTY AND ANOTHER PROPERTY ZONE GENERAL OFFICE LOW RISE NORTH OF THE PROPERTY NUMBER FOUR.

THE CITY OF BATON ROUGE PREVIOUSLY ADOPTED THE FUTURE BR COMPREHENSIVE PLAN OR COMPREHENSIVE PLAN, WHICH IS SUPPOSED TO BE A VISION FOR FUTURE DEVELOPMENT IN EAST BATON ROUGE PARISH.

IT WAS IMPLEMENTED IN THE PAST BUT ATTEMPTED TO PROJECT WHAT THE FUTURE MIGHT LOOK LIKE.

THE COMPREHENSIVE PLAN SPECIFICALLY STATES VR SHOULD BE USED TO GUIDE THE DEVELOPMENT OF SMALLER SCALE PLANS AND RELATED IMPLEMENTATION LEGISLATION OR PUBLIC INVESTMENT STRATEGIES FOR THE SMALL AREAS WITHIN THE CITY PARISH.

A POLICY DOCUMENT, NOT IRREGULATORY DOC REGULATION OF PROPERTY SUBDIVISION AND DEVELOPMENT AS A FUNCTION OF THE UDC ZONING MAP AND LAND USE MAPS SHOULD EVOLVE OVER TIME KEEPING TRUE TO THE OVERALL VISION BUT ADJUSTING TO NEW NEIGHBORHOOD PLANS, UNFORESEEN OPPORTUNITIES AND MINOR ADJUSTMENTS THAT WILL ARISE.

IT SHOULD EVOLVE OVER TIME AS THE CITY GROWS AND CHAINS.

IT IS CLEAR FROM READING OF THE COMPREHENSIVE PLAN THAT THE LAND USE DESIGNATION MAPS SHOULD BE AMENDED AND UPDATED OVER TIME AND THAT IS EXACTLY WHAT IS REQUESTED IN THIS APPLICATION.

NUMBER FIVE THERE WILL BE NO MEASURABLE IMPACT ON TRAFFIC WITH THIS ZONING OR CURRENT LAW.

OFFICE ON CARNEY ROAD IS ONLY ABOUT ONE AND A HALF MILES FROM THE PROPERTY.

THE MAJORITY OF THE BUSINESSES CONDUCTED THROUGH EMAIL AND TELEPHONE CURRENTLY AND IN THE PAST WHEN CLIENTS WOULD HAVE APPOINTMENTS AT THE OFFICE ON CORNY ROAD, THEY WOULD ALREADY TRAVEL DOWN.

OLD SCENIC HIGHWAY NUMBER SIX PROPERTIES LOCATED IN DISTRICT ONE AND WE HAVE BEEN WORKING WITH COUNCILMAN WELCH.

WE ARE NOT AWARE OF ANY OPPOSITION TO THE APPLICATIONS AND COUNCILMAN WEALTH SUPPORTS THE REZONING AND LAND USE DESIGNATION CHANGE BASED ON THE SUPPORT OF THE ADJOINING PROPERTY OWNER.

EVEN THOUGH TOWNHOMES ARE CURRENTLY PERMITTED.
